THE NEWHAM (MONEGA) (WAITING AND LOADING RESTRICTION) (NO. 1, 2010) (AMENDMENT NO. 2) EXPERIMENTAL TRAFFIC ORDER 2011

  • 1 Notice is hereby given that the Council of the London Borough of Newham on 4 April 2011 made the above-mentioned Orders under sections 9 and 124 of, and Part IV of Schedule 9 to, the Road Traffic Regulation Act 1984, as amended.
  • 2 The general effect of the Orders will be to further amend the Monega Residential Parking Zone (RPZ) so that:
    • a the hours that the Monega RPZ operates will be changed from Monday to Saturday between 8am and 10pm to Monday to Saturday between 8am and 6.30pm;
    • b the short stay parking place on the south-east side of Derby Road, adjacent to Nos. 318 to 330 Katherine Road, will be shortened from 18 metres to 8 metres and relocated north-eastward so as to lie between a point 27 metres north-east of the north-eastern kerb-line of Katherine Road and a point 1 metre north-east of a point opposite the south-western boundary of No. 2 Derby Road;
    • c the existing ‘at any time’ waiting restrictions on the south-east side of Derby Road, adjacent to Nos. 318 to 330 Katherine Road will be extended by 18 metres north-eastward up to the relocated short stay parking place mentioned in (b) above.
  • 3 The Orders, which will come into force on 18 April 2011, and other documents giving more detailed particulars of the Orders can be inspected during normal office hours on Mondays to Fridays inclusive at Reception, East Ham Town Hall, East Ham, London E6 2RP until such time as the Orders cease to have effect.
  • 4 Further information may be obtained by telephoning 020 3373 1347.
  • 5 Any person desiring to question the validity of any of the Orders or of any provision contained therein on the grounds that it is not within the relevant powers of the Road Traffic Regulation Act 1984 or that any relevant requirements thereof or any relevant regulations made there under has not been complied with in relation to any of the Orders may make application for the purpose to the High Court by 16 May 2011.
  • 6 If the provisions of any or all of the Orders continue in force for a period of not less than six months, the Council will be considering in due course whether the provisions of any or all of the original experimental Orders, as amended by these Orders, should be continued in force indefinitely by means of an Order or Orders under Sections 6 and/or 45 of the said Act of 1984.
  • 7 Within a period of six months –
    • a beginning with the day on which the experimental Orders come into force (i.e. between 18 April 2011 and 18 October 2011;
    • b if any Order is varied by another Order or modified pursuant to section 10(2) of the 1984 Act, beginning with the day on which the variation or modification or the latest variation or modification came into force, any person may object to the making of any or all of the Orders for the purpose of such indefinite continuation.
  • 8 Any such objection must be in writing, must state the grounds on which it is made and be sent to Traffic Orders and Parking, Environment Directorate, Newham Dockside, 1000 Dockside Road, London E16 2QU. Alternatively objections can be sent by email to “traffic.orders@newham.gov.uk”.
  • 9 Persons objecting to the Orders should be aware that in view of the Local Government (Access to Information) Act 1985, this Council may be legally obliged to make any comments in response to this notice open to public inspection.
