A Meeting of Creditors of the above-named Company has been summoned under Legislation section: Section 98 Legislation: of the Insolvency Act 1986 for the purposes mentioned in Sections 100 and 101 of the said Act. The meeting will be held at The Cathedral Quarter Hotel, St Mary’s Gate, Derby, DE1 3JR, on 08 December 2009, at 10.30 am . Creditors should lodge particulars of their claims for voting purposes at Cirrus Professional Services, 12 St Mary’s Gate, Derby, DE1 3JR, before the meeting. Secured creditors (unless they surrender their security) should also include a statement giving details of their security, the date/s on which it was given and the value at which it is assessed. Any creditor entitled to attend and vote at this meeting is entitled to appoint a proxy to attend and vote on his behalf. A form of general/special proxy for this purpose is available. Completed proxy forms must be lodged at 12 St Mary’s Gate, Derby, DE1 3JR, not later than 12.00 noon on Monday 7 December 2009. Notice is also given that Secured Creditors (unless they surrender their security) must give particulars of their security, the date when it was given and its value if they wish to vote at the meeting. The resolutions to be taken at the meeting may include a resolution specifying the terms on which the Liquidator is to be remunerated and to approve the basis of the Liquidator’s disbursements (alternatively the Liquidator may convene a further meeting on a later date for the purpose of obtaining such resolutions). In addition the meeting may receive information about, or be called upon to approve, the costs of preparing the statements of affairs and convening the meeting. Creditors should note that a copy of the Creditors’s Guide to Liquidators Fees is available on request from this office or a copy can also be found on the R3 website (www.r3.org.uk) under the heading ‘publications’ and follow the link to Statements of Insolvency Practice (SIP). SIP9 contains the relevant Creditor’s Guide. Notice is also given pursuant to Section 98(2) of the said Act that, on the two business days preceding the above meeting, a list of names and addresses of the company’s creditors will be available for inspection, free of charge, at 12 St Mary’s Gate, Derby DE1 3JR.
