PLANNING (LISTED BUILDINGS AND CONSERVATION AREAS) ACT 1990 (“THE 1990 ACT”), SECTION 69

THE WEIRS CONSERVATION AREA

NOTICE IS HEREBY GIVEN under the provisions of the Act that New Forest National Park Authority (“the Authority”) has determined that the area described in the Schedule to this Notice is an area of special architectural or historic interest, and that it is desirable to preserve or enhance its character or appearance. As a result, on 29 October 2009, the Authority designated the area as a “conservation area”.

The principal effects of the designation of this area as a conservation area are as follows:

  • 1 The Authority is under a duty to prepare proposals to ensure the preservation or enhancement of the area.
  • 2 The consent of the Authority must be obtained prior to the demolition of any building in the area.
  • 3 Additional publicity must be given to planning applications for development in the area.
  • 4 In carrying out any functions under the planning acts (and, in particular, in determining applications for planning permission and listed building consent), the Authority and the Secretary of State are required to take into account the desirability of preserving or enhancing the character or appearance of the area.
  • 5 Six weeks notice must be given to the Authority before works are carried out to any tree situated within the area.

Schedule

The boundaries are:

In a clockwise direction, from a point on Burley Road at the western boundary of Culverley Green and the junction of Armstrong Close and the track leading to North Weirs. Southeast to The Weir Stream, then southwest along the western boundary of Culverley Green to the boundary of the agricultural land. Southwest along and including the boundary bank to the north of the agricultural land to the boundary of Pound Farm. South, west and north around the boundary of Pound Farm to include the land and including land including Pound Farm and its outbuildings. Southwest along the boundary bank of the agricultural land to its junction with the track, south and southwest across the track, then north and west along the northern boundary of the agricultural land to its junction with the entrance to Ford Farm riding stables. Southwest along the boundary to the east of the path to a point opposite the southwest boundary of Ford Cottage, then north, west, and north to include the lands and including land including Ford Cottage and Linden House. West along the boundary bank to the agricultural land to the southeast corner of the boundary of Edgemoor Cottage. Southwest along the south eastern boundary of Edgemoor Cottage, Edgemoor House, Forest Reach, The Well House and Brereton to include the land and including land including Edgemoor Cottage, Edgemoor House, Forest Reach, The Well House and Brereton. Southeast, southwest, south, east, south, west along the eastern boundaries of Longdon, Hunt’s Green, Bay Tree House and 1 and 2 Forest View, to include the land and including land including of Longdon, Hunt’s Green, Bay Tree House and 1 and 2 Forest View. South following the boundary of the agricultural land along the eastern and northern boundaries of Farm Cottage, Setthorne View, Hincheslea View and then east, north, south and east to include the land and including land including Farm Cottage, Setthorne View, Hincheslea View and Pear Tree Cottage. South along the eastern boundary of Pear Tree Cottage and The Upper Ford along the west bank of the stream to a point on the south eastern corner of the land of The Upper Ford, then west along the southern boundary of The Upper Ford and Laurel Cottage to include the lands and including land including Pear Tree Cottage, The Upper Ford and Laurel Cottage. Southwest along the northwest boundary bank of the agricultural land to the entrance drive of The Lodge. South and southwest along the southern boundary of Worthy’s Farmhouse to the southern point of its associated land, then south, west, northwest and northeast to a point where the boundary bank joins the South Weirs Track to include the lands and including land including Worthy’s Farmhouse. Northwest and north along the path originally an extension to the South Weirs Track to a point where it joins Burley Road. Northeast along the northern boundary of Burley Road to a point where it joins the path going north to North Weirs to include the land of Furzey Hill bounded by the track and Burley Road. North along the footpath to North Weirs to a point where it joins the North Weirs Track opposite The Willows. Northwest and north along the western edge of the track to a point opposite the northwest corner of Thatchby Oak. East along the northern boundary of Thatchby Oak, then south along the eastern boundary of Thatchby Oak, Five Thorns and Five Thorns Cottage, then southwest along the southern boundary of Five Thorns Cottage then south and southeast along the north eastern boundaries of The Folly, Coronation Cottage and 1-9 Britton’s Cottages to include the lands and including land including Thatchby Oak, Five Thorns, Five Thorns Cottage, The Folly, Coronation Cottage and 1-9 Britton’s Cottages. East along the northern boundary of Knoleforth and The New House to the cattle grid, then east along the northern boundary bank of the North Weirs Track to the northwest corner of the land of Rose Cottage. Continuing east along the northern boundaries of Rose Cottage, Greenholm, The Thatch Cottage and Linnies to the junction of the North Weirs Track and Broadlands Road to include the lands and including land including Knoleforth, The New House, Thornacre, Rose Cottage, Greenholm, The Thatch Cottage and Linnies. East across Broadlands Road along the southern boundary of Broadlands Gate, The Foxley, Badgers Halt, Linfield Cottage and Weirs End, but not including these buildings or their lands. East across the junction of Armstrong Close and Burley Road to the western boundary of Culerley Green
