TOWN AND COUNTRY PLANNING ACT 1990
THE SECRETARY OF STATE hereby gives notice that he has made an Order under Section 247 of the above Act entitled “The Stopping up of Highway (East) (No. 37) Order 2009” authorising the stopping up of an irregular shaped southern length of the cul-de-sac Chapel Hill, comprising highway verge, commencing from its junction with the northern boundary of Mill Hill and extending in a northerly direction for a maximum distance of 10.5 metres at Braintree, in the District of Braintree to enable the development described in the Schedule to this notice to be carried out in accordance with planning permission granted to J Ahmed by Braintree District Council on 5 th November 2008 under reference 08/01632/FUL.
COPIES OF THE ORDER MAY BE OBTAINED, free of charge, on application to the Secretary of State, addressed to the National Transport Casework Team, Government Office for the North East, Citygate, Gallowgate, Newcastle upon Tyne NE1 4WH (quoting reference NATTRAN//E/S247/68) and may be inspected at all reasonable hours at Braintree District Council Offices (Mr J Brett), Causeway House, Braintree, Essex CM7 5HB.
ANY PERSON AGGRIEVED BY THE ORDER and desiring to question the validity thereof, or of any provision contained therein, on the ground that it is not within the powers of the above Act or that any requirement of that Act or of any regulation made thereunder has not been complied with in relation to the Order, may, within 6 weeks of the 23 July 2009 apply to the High Court for the suspension or quashing of the Order or of any provision contained therein.
