PLANNING (LISTED BUILDINGS AND CONSERVATION AREAS) ACT 1990 (“THE 1990 ACT”), SECTION 69

EXBURY CONSERVATION AREA

NOTICE IS HEREBY GIVEN under the provisions of the 1990 Act that New Forest National Park Authority (“the Authority”) has determined that the area described in the Schedule to this Notice is an area of special architectural or historic interest, and that it is desirable to preserve or enhance its character or appearance. Accordingly, on 29 January 2009, it amended the scope of Exbury Conservation Area.

The principal effects of the designation of this area as a conservation area are as follows:

  • 1 The Authority is under a duty to prepare proposals to ensure the preservation or enhancement of the area.
  • 2 The consent of the Authority must be obtained prior to the demolition of any building in the area.
  • 3 Additional publicity must be given to planning applications for development in the area.
  • 4 In carrying out any functions under the planning acts (and, in particular, in determining applications for planning permission and listed building consent), the Authority and the Secretary of State are required to take into account the desirability of preserving or enhancing the character or appearance of the area.
  • 5 Six weeks notice must be given to the Authority before works are carried out to any tree situated within the area.

Schedule

The boundaries are:

In a clockwise direction, from a point on Summer Lane at the northwest corner of the land of St Katherine’s Church, northeast, southeast, northeast, north, northeast, southeast, northeast, southeast along the northern boundary of the lands and including land including St Katherine’s Church, then northeast, east and south along the boundary of the land and including land including numbers 1, 2 and 3 The Crescent. Then east and south along the eastern boundary of The Crescent Road, east along the northern boundary of the track to the rear of the cottages to include the lands and including land including: Erica Cottage; Mitford Cottage; 1 and 2 Myrtle Cottages and 1 to 6 New Cottages, then southeast to a point at the southeast corner of the lands of New Cottages where it meets Lepe Road. East along the northern boundary of Lepe Road to the road junction northeast of The Old Rectory, then southeast along the eastern boundary to include the road junction and on to a point opposite the southeast corner of the lands of The Old Rectory. Cross the road, then west and northwest along the boundary of the land and including land including The Old Rectory. West along the southern boundary of Lepe Road to a point at the Northeast corner of the car park of The Exbury Club and Recreation Ground. South, west, south, west, north and west along the boundary of the car park and The Exbury Club to include the land and including land including the car park and The Exbury Club. South, west,north and west along the southern boundary of the land and including land including: The Ramblers; The Laurels; 1 to 3 Elm Tree Cottages; Ivy Cottage; Daphne Cottage; The Old Post Office and Lime Tree Cottage. Southeast along the eastern boundary of Inchmery Road, then cross the road at a point north of the entrance to Upper Exbury House. Southwest, west and north along the western boundary of the copse to a point southeast of Exbury House farm buildings, west, north and east to include the land and including land including the farm buildings, water tower and adjoining estate buildings. North crossing the driveway to the buildings and along the western boundary of the copse to the southwest corner of the land of South Lodge. North, crossing the main drive to Exbury House, then northeast to Summer Lane to include the lands and including land including: South Lodge and North Lodge. Cross Summer Lane then southeast along the eastern boundary of the land to a point on Summer Lane at the northwest corner of the land of St Katherine’s Church.
