PLANNING (LISTED BUILDINGS AND CONSERVATION AREAS) ACT 1990 (“THE 1990 ACT”), SECTION 69
BUCKLER’S HARD CONSERVATION AREA
NOTICE IS HEREBY GIVEN under the provisions of the 1990 Act that New Forest National Park Authority (“the Authority”) has determined that the area described in the Schedule to this Notice is an area of special architectural or historic interest, and that it is desirable to preserve or enhance its character or appearance. Accordingly, on 29 January 2009, it extended the boundaries of Buckler’s Hard Conservation Area.
The principal effects of the designation of this area as a conservation area are as follows:
- 1 The Authority is under a duty to prepare proposals to ensure the preservation or enhancement of the area.
- 2 The consent of the Authority must be obtained prior to the demolition of any building in the area.
- 3 Additional publicity must be given to planning applications for development in the area.
- 4 In carrying out any functions under the planning acts (and, in particular, in determining applications for planning permission and listed building consent), the Authority and the Secretary of State are required to take into account the desirability of preserving or enhancing the character or appearance of the area.
- 5 Six weeks notice must be given to the Authority before works are carried out to any tree situated within the area.
Schedule
The boundaries are:
In a clockwise direction, from a point on Buckler’s Hard Road at the southwest corner of the land of West Timber, north along the west boundary of the land and including land including West Timber, then west, northeast and northwest along the west field boundaries to include the land to a point on the southwest corner of the land of and including the Sailing Club. Northeast along the northwest boundary to include the land, and including land including the club house, to the bank of the Beaulieu River. Southeast along the southern bank of the Beaulieu River to include: the slipway; landing stage and river frontage to Buckler’s Hard to a point on the north eastern corner of the land of Buckler’s Hard. South, east, south, west, south and west to include the lands of Buckler’s Hard including land including all of the buildings of the Buckler’s Hard settlement, the car parks and the boat yard to a point at the junction with the road to St Leonard’s Grange. South then west then north to include the road junction and wide verges and west along the southern boundary of the Buckler’s Hard Road. Cross the road to a point at the southwest corner of the land of West Timber.
