Heat & Control Limited Retirement & Death Benefits Plan

Pursuant to Section 27 of the Trustee Act 1925

The Heat & Control Limited Retirement & Death Benefits Plan (the “Plan”) was established with effect from 27th July 1984.

Heat & Control Limited (the “Company”) entered administrative receivership on 17th November 1999. With effect from 22nd March 2000, pursuant to section 23 of the Pensions Act 1995, MacRoberts, Solicitors of 152 Bath Street, Glasgow, G2 4TB was appointed as the independent trustee of the Plan by the Company’s Administrative Receivers to administer the Plan.

MacRoberts, Solicitors has corresponded by post with all known members of the Plan and is proceeding to wind up the Plan. Accordingly, it is of vital importance that any person having a claim against or an interest in the Plan, including any person who may have been employed by the Company or an associated employer on a part-time basis and who considers that his or her exclusion from the Plan may have constituted indirect discrimination, who has not received correspondence from MacRoberts, Solicitors should make themselves known to MacRoberts, Solicitors.

Particulars of any claim should be set out in writing and sent to the contact noted below on or before 31st May 2004, following which the Plan trustee will conclude the Plan’s winding up and distribute its assets having regard only to the claims and interests of which it has had notice not later than 31st May 2004.

Notification is not required from individuals who are currently in receipt of a pension from the Plan, who have transferred their Plan entitlement to another pension scheme or arrangement or who are receiving correspondence relating to the Plan from MacRoberts, Solicitors.
