Notice to Claimants of funds held in the Company’s former bank accounts of an intention to distribute the funds pursuant to a Distribution Plan.

On 10 February 2020, Jonathan David Bass and Freddy Khalastchi (“the Liquidators”), the Joint Liquidators of the Company applied to the High Court of Justice, Business and Property Courts of England and Wales, Insolvency and Companies List (ChD) pursuant to s.112(1) of the Insolvency Act 1986 under claim number CR-2018-006644 (“the Application”). By the Application, the Liquidators sought directions in relation to the monies standing to the credit of the Company’s bank accounts (“the Monies”).

The Liquidators gave notice of the Application (via the creditors’ portal) to all persons who had previously notified the Liquidators that they have a claim against the Company, as set out in the schedule to the Application (“the Notified Claimants”).

On 27 November 2020, Deputy Insolvency and Companies Court Judge Agnello QC ordered the Liquidators to prepare a plan for the distribution of the Monies and serve it on the Notified Claimants.

Notice is given that pursuant to paragraph 4 of Deputy Insolvency and Companies Court Judge Agnello QC’s Order dated 27 November 2020, any other person who has a claim against the Company in respect of the Monies must notify the Liquidators in writing by letter or email to the addresses stated below by no later than 4pm on 29 January 2021.

Any person who does not notify the Liquidators of their claim by 4pm on 29 January 2021 in accordance with paragraph 4 of Deputy Insolvency and Companies Court Judge Agnello QC’s Order dated 27 November 2020 will not be entitled to file and serve evidence and/or make representations at the final hearing of the Application, will not be eligible for distribution under any proposed distribution plan and will not be entitled to disturb any distribution made in accordance with an approved distribution plan because they have not participated in it. This is without prejudice to any further order of the Court in relation to entitlement to any distribution.
