Notice is hereby given, pursuant to Rule 15.13 of the Insolvency (England and Wales) Rules 2016, that the Directors of the abovenamed Company (the 'convener(s)') are seeking a decision from creditors on the nomination of Joint Liquidators by way of a physical meeting. A resolution to wind up the Company is to be considered on 10 July 2020. Decisions regarding the Joint Liquidators remuneration and the formation of a liquidation committee may also be sought at the meeting.
Please note, that in accordance with the current guidelines about social distancing from the UK Government, it will not be possible to hold a physical meeting during the current COVID-19 pandemic and consequently the meeting will be held virtually instead and creditors can attend and participate in this meeting remotely by telephone and/or video conferencing facilities.
In order to make suitable arrangements to ensure that those wishing to participate are able to do so, creditors are requested to contact Casey Matthews via insol@bcr-insolvency.co.uk in order that the necessary information as to how to access the meeting can be sent to them. All proxy forms should be delivered by email to insol@bcrinsolvency.co.uk in advance of the meeting.
The meeting will be held remotely on 10 July 2020 at 11:00am. As a result of the requirement to hold this virtual physical meeting the original deemed consent procedure is superseded.
Philip B Wood and Christopher Knott of Barringtons Corporate Recovery, 570-572 Etruria Road, Newcastle, Staffordshire, ST5 0SU are persons qualified to act as insolvency practitioners in relation to the company who, during the period before the meeting date, will furnish creditors free of charge with such information concerning the Company's affairs as they may reasonably require.
A creditor may appoint a person as a proxy-holder to act as their representative and to speak, vote, abstain or propose resolutions at the meeting. A proxy for a specific meeting must be delivered to the chair before the meeting. In order to be counted a creditor's vote must be accompanied by a proof in respect of the creditor's claim (unless it has already been given). A vote will be disregarded if a creditor's proof in respect of their claim is not received by 4pm on 9 July 2020 (unless the chair of the meeting is content to accept the proof later).
