BLOCK TRANSFER OF APPOINTMENTS BETWEEN OFFICE HOLDERS IN THE MATTER OF AN OFFICE HOLDER

Between: Stephen Gilmore (Applicant) and James Paul Shaw (Respondent).

Notice is hereby given that pursuant to an order made by His Honour Judge Hodge QC sitting as a Judge in the High Court of Justice, Chancery Division of the Manchester District Registry on 17 August 2012.

1. Stephen Gilmore be removed from office as Trustee in Bankruptcy of the bankruptcies listed in Schedule 1 attached hereto pursuant to Section 298(1) of the Insolvency Act 1986, with effect from 17 August 2012 and James Paul Shaw be appointed as Trustee in Bankruptcy in substitution in respect of the said bankruptcies with effect from the same date pursuant to Section 303(2) of the Insolvency Act 1986.

2. Stephen Gilmore be removed from office as Supervisor of the voluntary arrangements listed in Schedule 2 attached hereto pursuant to Section 263(5) of the Insolvency Act 1986, with effect from 17 August 2012 and James Paul Shaw be appointed as Supervisor in substitution in respect of the said voluntary arrangements with effect from the same date.

3. Stephen Gilmore be removed from office as Liquidator of the companies in voluntary liquidation listed in Schedule 3 attached hereto pursuant to Section 108 of the Insolvency Act 1986, with effect from 17 August 2012 and James Paul Shaw be appointed as liquidator in substitution in respect of the said companies with effect from the same date pursuant to Section 108 of the Insolvency Act 1986.

4. Stephen Gilmore be removed from office as Liquidator of the companies in compulsory liquidation listed in Schedule 4 attached hereto pursuant to Section 172(2) of the Insolvency Act 1986, with effect from 17 August 2012 and James Paul Shaw be appointed as liquidator in substitution in respect of the said companies with effect from the same date pursuant to Section 168(3) of the Insolvency Act 1986.

5. Those of the Bankruptcies and Liquidations listed in Schedules 1 and 4 attached hereto which are (or were) proceeding in a County Court be transferred to the High Court for the purpose of this Order only.

6. James Paul Shaw shall, when the next routine report is due to the creditors/members of each Bankruptcy, Voluntary Arrangement, Creditors’ Voluntary Liquidation and Compulsory Liquidation, give written notice of the making of this order to each such creditor/member, such notice to include the following matters:

(a) An explanation as to the effect of the order; and

(b) Express reference to the liberty to apply as set out in the order.

7. Liberty to each creditor/member of each Bankruptcy, Voluntary Arrangement, Creditors’ Voluntary Liquidation and Compulsory Liquidation to apply to vary or discharge this order within 28 days of receipt of the notices directed to be sent under paragraph 6 above.

8. The costs of this application be borne as an expense of each case as referred to in the schedules attached. The costs allocated to each case shall not exceed 10% of the realisations in that case.
