Notice is hereby given, that a petition for the winding-up of the above-named Association, whose registered office is situate at The Cornmill, Durham City in the County of Durham DH1 3EA by the High Court of Justice holden at Durham City was on 29 September 2011, presented to the said Court by Police Constable Owain Harris and Susan Harris both of 14 Thornbridge, Teal Farm, Washington, in the County of Tyne-and-Wear DH1 4HU and Lindsay Craig of 10, Tollhouse Road, Durham City in the County of Durham DH1 4UH and who together are the Executive Board and registered Trustees of the Association; and that the said petition is directed to be heard before the Court sitting at the Civil and Family Justice Centre, The Green, Durham City in the County of Durham DH1 3RG on 18 November 2011 at 2 o’clock in the afternoon (or as soon thereafter as the petition can be heard); and any creditor, contributory, member or corporate member of the said Association desirous to support or oppose the making of an Order on the said petition may appear at the same hearing, by himself in person or by way of his Counsel or Solicitor Advocate, for that purpose; and a copy of the petition will be furnished to any creditor, contributory, member or corporate member of the said Association requiring the same by the undersigned, on payment of the regulated charge for the same.
Notice is further given that if the honourable court is not minded to make such an order on the Petition then the Petitioners will pray the court to make an Order to dissolve the Association under the authority set forth by the learned Mr Justice Warrington in In re: Lead Company’s Workmen’s Fund Society: Lows v. Governor and Company for Smelting Down Lead with Pit and Sea Coal [1904] 2 Ch. 196 and the learned Mr Justice Kekewich in Blake v. Smither (1906) 22 T.L.R. 698.
