TOWN AND COUNTRY PLANNING ACT 1990
THE SECRETARY OF STATE hereby gives notice of an Order made under Section 247 of the above Act entitled “The Stopping up of Highway (West Midlands) (No. 42) Order 2013” authorising the stopping up of a western part width of the un-named highway that emanates from Dawberry Fields Road to the west of No. 177 and No. 179 Dawberry Fields Road at Kings Heath, in the City of Birmingham to enable development as permitted by Birmingham City Council, reference 2012/08295/PA.
COPIES OF THE ORDER MAY BE OBTAINED, free of charge, from the Secretary of State, National Transport Casework Team, Tyneside House, Skinnerburn Road, Newcastle Business Park, Newcastle upon Tyne, NE4 7AR (quoting NATTRAN/WM/S247/910) and may be inspected during normal opening hours at City Design Team, Development Directorate, Birmingham City Council, 2nd Floor, Lancaster Circus, Birmingham B1 1TR
ANY PERSON aggrieved by or desiring to question the validity of or any provision within the Order, on the grounds that it is not within the powers of the above Act or that any requirement or regulation made has not been complied with, may, within 6 weeks of 12 December 2013 apply to the High Court for the suspension or quashing of the Order or of any provision included.
