THE DONCASTER BOROUGH COUNCIL (A6182 FINNINGLEY AND ROSSINGTON REGENERATION ROUTE SCHEME CLASSIFIED ROAD) COMPULSORY PURCHASE ORDER 2012
THE HIGHWAYS ACT 1980 AND THE ACQUISITION OF LAND ACT 1981
- 1 Notice is hereby given that the Secretary of State for Transport, in exercise of his powers under the above Acts, on 19th August 2013 confirmed The Doncaster Borough Council (A6182 Finningley and Rossington Regeneration Route Scheme Classified Road) Compulsory Purchase Order 2012 submitted by the Doncaster Borough Council.
- 2 The order as confirmed provides for the purchase of the land and the new rights described
in the Schedule hereto for the purposes of
- a the construction of a highway between the M18 Motorway Junction 3 Roundabout and the A638 Bawtry Road/Great North Road at point about 115 metres south of its junction with the B6463 Sheep Bridge Lane in the Borough of Doncaster in the County of South Yorkshire;
- b the construction of a highway to connect the highway mentioned in (a) above to western end of West End Lane, Rossington;
- c the improvement of existing highways, construction of new roads and provision of new means of access to premises in the vicinity of the route of the highways mentioned in (a) and (b) above pursuance of the Doncaster Borough Council (A6182 Finningley and Rossington Regeneration Route Scheme Classified Road) (Side Roads) Order 2012;
- d the stopping up or diversion of existing roads, public footpaths, bridleways, greenways and private means of access and the provisions of new public footpaths, bridleways, greenways and private means of access to premises in the vicinity of the route of the highways mentioned in (a) and (b) above in pursuance of the Doncaster Borough Council (A6182 Finningley and Rossington Regeneration Route Scheme Classified Road) (Side Roads) Order 2012;
- e use by the acquiring authority in connection with the construction and improvement of highways, the provision of public footpaths, bridleways, greenways and new means of access to premises as aforesaid and the execution of other works mentioned above;
- f the carrying out of works on watercourses in connection with the construction and improvement of highways as aforesaid;
- g mitigating the adverse effect which the existence and use of the highways proposed to be constructed and improved will have on the surroundings thereof; and
- h the improvement or development of frontages to the A638 Bawtry Road/Great North Road at Parrott’s Corner Junction or of the land adjoining or adjacent thereto.
- 3 A copy of the order as confirmed by the Secretary of State and of the map referred to therein have been deposited at offices of the Council at the Directorate of Development, Civic Office, Waterdale, Doncaster, DN1 3BU further places of deposit in the area include Doncaster Central Library, Waterdale, Doncaster, DN1 3JE ; Rossington Community Library, Holmescarr Enterprise Centre, Grange Road, Rossington, DN11 0LP and Cantley Library, Goodison Boulevard, Cantley, Doncaster, DN4 6BT and may be seen at all reasonable hours.
- 4 The order as confirmed becomes operative on the date on which this notice is first published. A person aggrieved by the order may, by application to the High Court within 6 weeks from that date, challenge its validity under section 23 of the Acquisition of Land Act 1981. The grounds for challenge can be that the authorisation granted by the order is not empowered to be granted or that there has been a failure to comply with any relevant statutory requirement relating to the order.

SUMMARY DESCRIPTION OF LAND AND THE NEW RIGHTS
- a Small strips of agricultural land adjacent to Hall Balk Lane;
- b The access track from Hall Balk Lane to Rakes Lane alongside Huxter Well Drain and small strips of agricultural land adjacent to it;
- c The access track between its connection with the track in (b) above to the north of the M18 Motorway and the western end of Beeston Underpass, and small strips of agricultural land adjacent to it;
- d A narrow strip of land adjacent to the eastbound exit slip to the M18 Motorway;
- e Rakes Lane from the Rakes Lane railway bridge to the underpass at the M18;
- f A strip of agricultural land in-between the M18 Motorway and Huxter Well Drain from the M18 Junction 3 Roundabout to the Huxter Well pumping station crossed by the Brancliffe to Kirk Sandall Railway Line and including part of Cottage Plantation and a disused barn at Potteric Carr Farm;
- g A strip of agricultural land from Huxter Well Drain to the River Torne north of the former Rossington Colliery;
- h A strip of land across the former Rossington Colliery from its northern boundary at the River Torne to West End Lane at Rossington;
- i A strip of pasture land in-between the M18 Motorway and the River Torne from Huxter Well Pumping Station to the Mother Drain at Doncaster Golf Club crossed by the East Coast Main Line Railway;
- j A strip of pasture land at Doncaster Golf Club in-between the Mother Drain and the southern boundary of the Golf Course from the south western corner of the course towards Parrott’s Corner;
- k A strip of pasture land from the Mother Drain to the Parrott’s Corner junction;
- l A strip of land forming the northern corner of the Parrott’s Corner Park-and-Ride site;
- m A strip of pasture land in-between the River Torne and Sheep Bridge Lane at Parrott’s Corner;
- n strip of agricultural land adjacent to the northern corner of the A638 Great North Road/Hurst Lane junction; and
- o New rights include to construct and maintain highways, bridges, embankments and drainage, etc; to carry out and maintain mitigation works; to divert, install, use and maintain drains, pipes, cables, etc; to create and maintain flood storage and compensation areas and other new rights and temporary rights including for construction access, construction working space, site accommodation, storage and for crane over- sailing and other purposes.
