HIGHWAYS ACT 1980 – SECTION 116 APPLICATION
DONHEAD ST. MARY BYWAY 9
Notice is hereby given that Wiltshire Council intends to make application to the Magistrates’ Court sitting at Wilton Road, Salisbury in the said County on 3 December 2012 at 11.45 a.m. for an Order authorising the diversion of Byway 9, Donhead St Mary on the ground that the proposed new route would be more commodious to the public. Currently, the byway runs from a point (A) at its junction with Donhead St Mary 3, leading east for a distance of approximately 455 metres to a point (B). The diverted route would run from point (A) leading generally parallel to its current length, via a point (C) to point (B) with an approximate total length of 465 metres with a width varying from 4.2 metres to 10 metres. The diverted route is already widely-used but has no legal status. It would have a specified minimum width of 4.2 metres, making it safer and more pleasant to use for walkers and riders.
A copy of the application notice and plan may be obtained from Mr. Gale of Legal Services on tel. No. (01225) 718023 or inspected free of charge by prior arrangement with Mr. Gale at Shurnhold, Melksham, during normal office hours. Notice will also be advertised on site at least 28 days before the application. Any person upon whom notice has been served, any person who uses the highway or any other person who would be aggrieved by the making of the Order may attend or write to the court and make their objections or representations known. If they have not already done so, such persons are also requested to give advance notice and details in writing to the Solicitor to the Council, quoting reference KG/WCS 16203.
