TOWN AND COUNTRY PLANNING ACT 1990

THE SECRETARY OF STATE hereby gives notice that she has made an Order under Legislation section: Section 247 of the above Act entitled “The Stopping up of Highway (East Midlands) (No. 5) Order 2012” authorising the stopping up of an area of grass verge and footpath, a western and southern part width, and an irregular shaped area of land at Calver Avenue, North Wingfield, in the District of North East Derbyshire to enable the development described in the Schedule to this notice to be carried out in accordance with the planning permission granted under Part III of the Act to Mr D Rodgers by North East Derbyshire District Council on 25 February 2011 under reference 10/00790/RM.

COPIES OF THE ORDER MAY BE OBTAINED, free of charge, on application to the Secretary of State, addressed to the National Transport Casework Team, 2nd Floor, Lancaster House, Hampshire Court, Newcastle Business Park, Newcastle upon Tyne, NE4 7YH (quoting reference NATTRAN/EM/S247/412) and may be inspected at all reasonable hours at North Wingfield Post Office, 14 The Green, North Wingfield, Chesterfield, Derbyshire, S42 5LQ .

ANY PERSON AGGRIEVED BY THE ORDER and desiring to question the validity thereof, or of any provision contained therein, on the ground that it is not within the powers of the above Act or that any requirement of that Act or of any regulation made thereunder has not been complied with in relation to the Order, may, within 6 weeks of the 23 February 2012 apply to the High Court for the suspension or quashing of the Order or of any provision contained therein.

Planning permission is granted for application for approval of reserved matters following outline approval 08/00496/OL for erection of 25 residential units (24 two storey dwellings and 1 first floor flat above parking spaces) together with associated roadway, landscaping and boundary treatments (Major Development) (Amended Title/Amended Plan) at Calver Avenue, North Wingfield, Derbyshire .
