THE BRENT (WAITING AND LOADING RESTRICTION) (AMENDMENT NO. 379) ORDER 2012

  • 1 NOTICE IS HEREBY GIVEN that the Council of the London Borough of Brent have made the above mentioned Orders under sections 6, 45, 46, 49 and 124 of and Part IV of Schedule 9 to the Road Traffic Regulation Act 1984, as amended by section 8 of and Part 1 of Schedule 5 to the Local Government Act 1985, the Parking Acts of 1986 and 1989 and the Traffic Management Act 2004.
  • 2 The general effect of the ‘Prohibition of Stopping Outside Schools’ Order will be to:-
    • a revoke the existing school entrance markings in the streets specified in Schedule 1 to this Notice;
    • b re-impose those school entrance markings in the streets specified in Schedule 1 to this Notice, so as to prohibit any vehicle stopping or remaining at rest between 8.15 a.m. and 9.15 a.m. and 2.30 p.m. and 4.30 p.m. on Mondays to Fridays inclusive with minor amendments to length of generally less than 3 metres in those streets specified with an asterisk in Schedule 1 to this Notice;
    • c revoke the existing school entrance markings in the streets specified in Schedule 2 to this Notice;
    • d re-impose those school entrance markings in the streets specified in Schedule 2 to this Notice, so as to prohibit any vehicle stopping or remaining at rest between 8.00 a.m. and 9.30 a.m. and 2.30 p.m. and 4.30 p.m. on Mondays to Fridays inclusive.
  • 3 The prohibition in Article 2 above will not apply to:-
    • a any person causing or permitting a vehicle to stop or remain at rest:-
      • i if that person is obliged to do so in order to prevent an accident; or
      • ii if that person is required to do by law;
      ii if that person is required to do by law;
    • b anything done with the permission or at the direction of a police constable in uniform or in accordance with any restriction or requirement indicated by traffic signs placed on the highway by or on behalf of the Metropolitan Police.
  • 4 The general effect of the ‘Parking Places Amendment’ Order will be to redefine the existing shared use parking bay opposite Nos. 229 to 255 Harvist Road.
  • 5 The general effect of the ‘Waiting and Loading Restrictions’ Order will be further to amend the Brent (Waiting and Loading Restriction) Order 1979, so that:-
    • a waiting by vehicles (otherwise than for the purpose of delivering or collecting goods or loading or unloading a vehicle) will be prohibited at any time in the lengths of streets specified in Schedule 3 to this Notice;
    • b waiting by vehicles (otherwise than for the purpose of delivering or collecting goods or loading or unloading a vehicle) will be prohibited between 8.30 a.m. and 6.30 p.m. on Mondays to Fridays in the length of street specified in Schedule 4 to this Notice;
    • c waiting by vehicles (otherwise than for the purpose of delivering or collecting goods or loading or unloading a vehicle) will be prohibited between 8.00 a.m. and 6.30 p.m. on Mondays to Saturdays in the length of street specified in Schedule 5 to this Notice;
    • d waiting by vehicles (otherwise than for the purpose of delivering or collecting goods or loading or unloading a vehicle) will be prohibited between 8.15 a.m. to 9.15 a.m. and 2.30 p.m. to 4.30 p.m. on Mondays to Fridays in the length of street specified in Schedule 6 to this Notice;
    • e waiting by vehicles for the purpose of delivering or collecting goods or loading or unloading a vehicle for a period of more than 20 minutes in the same place will be prohibited between 11.00 a.m. and 6.30 p.m. throughout the week in the lengths of streets specified in Schedule 3 to this Notice, between 11.00 a.m. and 6.30 p.m. on Mondays to Fridays in the length of street specified in Schedule 4 to this Notice, between 11.00 a.m. and 6.30 p.m. on Mondays to Saturdays in the length of street specified in Schedule 5 to this Notice and between 8.15 a.m.- 9.15 a.m. and 2.30 p.m.- 4.30 p.m. on Mondays to Fridays in the length of street specified in Schedule 6;
    • f the sale or offer for sale of goods from a vehicle will be prohibited (except on Sundays in the lengths of streets specified in Schedules 3 to 6) unless there is in force a valid licence issued by the Brent Borough Council or the goods are immediately taken into or delivered at premises adjacent to the vehicle from which the sale is effected;
    • g the use of any vehicle or of any animal or the wearing of fancy dress or other costume, wholly or mainly for the purpose of advertising will be prohibited;
    • h any existing prohibition on the waiting by vehicles, the sale or offer for sale of goods from a vehicle or the use of any vehicle or animal or the wearing of fancy dress or other costume wholly or mainly for the purpose of advertising in the lengths of streets specified in Schedules 3 to 6 to this Notice will be revoked.
  • 6 The prohibitions referred to in sub-paragraph 5(a) to (d) above will not apply in respect of anything done with the permission or at the direction of a police constable in uniform or in certain circumstances, e.g., the picking up or setting down of passengers; the carrying out of statutory powers or duties; the taking in of petrol, etc., from roadside petrol stations; to licensed street traders, etc. The usual exemption relating to vehicles displaying a disabled person’s “Blue Badge” will apply.
  • 7 Copies of the Orders, which will come into operation on 20th February 2012, of maps of the relevant areas, of the amended or revoked Orders of 1979, 1995, 1998, 2000, 2002, 2003, 2004, 2007, 2008, 2010 and 2011 can be inspected during normal office hours on Mondays to Fridays inclusive until the end of six weeks from the date on which the Orders were made at:-
    • a The One Stop Shop, Brent Town Hall, Forty Lane, Wembley, Middx, HA9 9HX; and
    • b The One Stop Shop, Brent House, 349-357 High Road, Wembley, Middx, HA9 6BZ.
  • 8 Copies of the Orders may be purchased from the address mentioned in paragraph 7(b) above.
  • 9 Any person desiring to question the validity of the Orders or of any provision contained therein on the grounds that it is not within the relevant powers of the Road Traffic Regulation Act 1984 or that any of the relevant requirements thereof or of any relevant regulations made thereunder has not been complied with in relation to the Orders may, within six weeks of the date on which the Orders were made, make application for the purpose to the High Court.
