RELATING TO DAMSON WAY, CARSHALTON BEECHES AND SHOTFIELD, CARSHALTON

  • 1 NOTICE IS HEREBY GIVEN that the Council of the London Borough of Sutton made The Sutton (Free Parking Places) (Buses) (Limited Time) (Experimental Order No.3) 2011 on 12 December 2011 under sections 9, 10 and 124 of, and Part IV of Schedule 9 to, the Road Traffic Regulation Act 1984, as amended.
  • 2 The principal objective of the Experimental Order is to provide designated parking places where coaches can wait so that pupils and staff from the new Stanley Park High School may board and alight from the coaches in safety. The Order, however, would not preclude other coaches from using the parking places.
  • 3 The general effect of the Order will be to introduce a parking place located along

• Damson Way for coaches to wait for up to 10 minutes with no return within 15 minutes on Mondays to Fridays between the hours of 7.30 am to 9.30 am and between 3.30 pm to 4.30 pm; and

• Shotfield for coaches to wait for up to 10 minutes with no return within 15 minutes on Mondays to Saturdays between the hours of 7.30 am and 6.30 pm.

The order will be introduced on an experimental basis. [Order Reference FR888]

  • 4 Full details of the Experimental Order, which will come into operation on 16 January 2012, are contained in the following documents:
    • a the Order;
    • b the Council’s Statement of Reasons for making the Order; and
    • c plans showing the location and effect of the restrictions.

These may be examined at the Council’s Civic Offices at St. Nicholas Way, Sutton and at the Environment and Leisure Offices at 24 Denmark Road, Carshalton between 9am - 5pm Monday to Friday.

  • 6 The Order provides that in pursuance of section 10(2) of the Road Traffic Regulation Act 1984, the Executive Head of Planning and Transportation of the Council of the London Borough of Sutton, or some other person authorised in that behalf by that officer may, if it appears to that officer or to that other person essential in the interests of the expeditious, convenient and safe movement of traffic, or of the provision of suitable and adequate parking facilities on the highway, or for preserving or improving the amenities of the area through which the road affected by this Order runs, modify or suspend this Order or any of its provisions save that no modification shall make an addition.
  • 7 If the provisions of the Order continue in operation for a period of not less than six months, the Council of the London Borough of Sutton will consider in due course whether the provisions of the Order should be reproduced and continued in force indefinitely by means of an Order under section 6 of the said Act of 1984. Persons desiring to object to the making of such an Order for the purpose of such reproduction and continuation in force may, within the period of six months referred to above (ie by 15 July 2012 ), or within six months of the date on which any modification to this Order may come into force, send a statement in writing of their objection and the grounds of that objection to Caroline McGlynn, Smarter Travel Sutton, London Borough of Sutton, 24 Denmark Road, Carshalton, Surrey, SM5 2JG, quoting the following reference FR888.
  • 8 If any person wishes to question the validity of the Order or of any of its provisions on the grounds that it or they are not within the powers conferred by the Road Traffic Regulation Act 1984, or that any requirement of the said Act of 1984 or of any instrument made under the said Act of 1984 has not been complied with, that person may, within 6 weeks from the date on which the Order is made, apply for the purpose to the High Court.
