PLANNING (LISTED BUILDINGS AND CONSERVATION AREAS) ACT 1990 SECTIONS 69 AND 70
EXTENSION OF FOREST HILL CONSERVATION AREA, LONDON SE23
This Notice is given pursuant to section 70 of the above Act. On 12th March 1976 the Council designated Forest Hill Conservation Area London SE23 a Conservation Area (“the Conservation Area”). On the 8th July 1997 Conservation Area was extended. On 14th July 2010 the Council has determined that alterations to the Conservation Area should be made.
The land described in the Schedule 1 below should be added to the Conservation Area. It is considered that this land has special architectural or historic interest, the character or appearance of which it is desirable to preserve or enhance which merits its inclusion within the Forest Hill Conservation Area. The Council has therefore decided to vary the designated Conservation Area by adding the land described in the Schedule below to the Forest Hill Conservation Area London, SE23
The effect of including the land described in the Schedule below within the Forest Hill Conservation Area (“the Conservation Area”) is as follows:
- 1 Conservation area consent will now be required before the demolition of any unlisted buildings located in the Conservation Area (other than excepted buildings) can take place. (demolition includes substantial demolition)
- 2 Planning applications for development in the Conservation Area, which would, in the Council’s opinion affect the character or appearance of the Conservation Area, must be given publicity. Representations received as a result of that publicity must be taken into account in determining those applications.
- 3 In carrying out any functions, under the Planning Acts (and in particular, in determining applications for planning permission and listed building consent) in respect of land in the Conservation Area, the authority is under a duty to pay special attention to the desirability of preserving or enhancing the area’s historic character and appearance
- 4 Six weeks notice must be given to the Council before any works are carried out to a tree in the area. It is a criminal offence to carry out works to a tree in a conservation area without informing the Council six weeks prior to the commencement of the works.
- 5 The Council is now under a duty to formulate and publish proposals for the preservation and enhancement of the Conservation Area.
- 6 Permitted development rights for development in the Conservation Area are more restricted than before (persons wishing to exercise those rights within the Conservation Area should first check the extent to which they may do so with the Council’s Planning Department).
- 7 The display of new illuminated advertisements on business premises in the Conservation Area will require express advertisement consent. Advertisements displayed prior to the date of the extension of the Conservation Area under Class 4b and 8 of the Town & Country Planning (Control of Advertisements) Regulations 2007 are subject to the prescribed time limits for there continued display under the regulations.
- 8 Specific statutory duties are imposed upon telecommunications operators.
