TOWN AND COUNTRY PLANNING ACT 1990

THE SECRETARY OF STATE hereby gives notice that he has made an Order under Section 247 of the above Act entitled “The Stopping up of Highways (West Midlands) (No.21) Order 2010” authorising the stopping up of a south western part width of Carisbrooke Avenue and areas of highway verge and unnamed Footpaths bounded by Carisbrooke Avenue, Lumley Grove, Warwick Court and The Baptist Church Centre at Chelmsley Wood in the Metropolitan Borough of Solihull, to enable the development described in the Schedule to this notice to be carried out in accordance with planning permission granted to Bellway Homes (West Midlands) by Solihull Metropolitan Borough Council on 24 November 2009 under reference 2009/1453.

COPIES OF THE ORDER MAY BE OBTAINED, free of charge, on application to the Secretary of State, addressed to the National Transport Casework Team, Government Office for the North East, Citygate, Gallowgate, Newcastle upon Tyne NE1 4WH (quoting reference NATTRAN/ WM/S247/99) and may be inspected at all reasonable hours at Chelmsley Wood Library, Stephenson Drive, Chelmsley Wood, Solihull, B37 5TA.

ANY PERSON AGGRIEVED BY THE ORDER and desiring to question the validity thereof, or of any provision contained therein, on the ground that it is not within the powers of the above Act or that any requirement of that Act or of any regulation made thereunder has not been complied with in relation to the Order, may, within 6 weeks of the 24 June 2010 apply to the High Court for the suspension or quashing of the Order or of any provision contained therein.

Planning permission is granted for redevelopment of land to provide 20 No. dwellings with associated access, parking and landscaping at land at Carisbrooke Avenue, Chelmsley Wood.
