THE BRENT (GOODS VEHICLES) (FREE LOADING PLACES) (NO. 2) ORDER 2010

  • 1 NOTICE IS HEREBY GIVEN that the Council of the London Borough of Brent on 29 March 2010 made the above-mentioned Orders under sections 6, 45, 46, 49 and 124 of and Part IV of Schedule 9 to the Road Traffic Regulation Act 1984 as amended by section 8 of and Part 1 of Schedule 5 to the Local Government Act 1985, the Parking Acts of 1986 and 1989 and the Traffic Management Act 2004.
  • 2 The general effect of the ‘Parking Places’ Order will be to:-
    • a designate parking places that will operate between 12.00 noon and 3.00 p.m. Mondays to Fridays in certain lengths of All Souls Avenue (from Chamberlayne Road to Nos. 124 and 126 All Souls Avenue);
    • b specify that:-
      • i each parking place may be used, subject to the provisions of the Order, for the leaving during the permitted hours of such vehicles as are passenger vehicles, goods carrying vehicles or invalid carriages displaying a valid parking ticket or permit. Motor cycles park free;
      • ii the maximum initial period for which a vehicle, displaying a valid parking ticket may be left during the permitted hours in the parking places in All Souls Avenue (outside Nos. 227, 229 and 231) will be 2 hours;
      • iii the charge for short term parking in the parking places in All Souls Avenue (outside Nos. 227, 229 and 231) will be 30 pence for 20 minutes, 60 pence for 40 minutes, £1.50 for 1 hour and £3.30 for 2 hours, the tickets for which will be issued by pay and display meters;
      • iv the interval before a vehicle may again be left in a parking place after the expiration of the period for which the initial charge was incurred will be 2 hours;
      • v any resident whose usual place of abode is in All Souls Avenue (from Chamberlayne Road to Nos. 124 and 126 All Souls Avenue) may apply to the Council for the issue of a residents permit valid for use in existing permit holders parking places in the KH Zone and the parking places in All Souls Avenue (from Chamberlayne Road to Nos. 124 and 126 All Souls Avenue). Existing KH zone permits will now be valid for use in the parking places situated in All Souls Avenue (from Chamberlayne Road to Nos. 124 and 126 All Souls Avenue);
      • vi a maximum of 3 permits per residential postal address will be issued by the Council or its agents, to persons whose usual place of abode is in All Souls Avenue (from Chamberlayne Road to Nos. 124 and 126 All Souls Avenue). The charges will be £50 per annum (no charge for electric vehicles or if the vehicle engine size is less than 1101cc) or £31 for six months (no charge for electric vehicles or if the vehicle engine size is less than 1101cc) for the first permit, £75 per annum (£43.50 for six months) for the second permit and £100 per annum (£56 for six months) for the third permit. Unexpired permits that have been paid for and surrendered to the Council will be entitled to a refund of one twelfth of the charge paid (one sixth for 6 months permits) in respect of each unexpired month, subject to a maximum refund of one third;
      • vii any resident whose usual place of abode is in All Souls Avenue (from Chamberlayne Road to Nos. 124 and 126 All Souls Avenue) may apply to the Council for the issue of visitor’s permits valid for the period between 12.00 noon and 3.00 p.m. Mondays to Fridays, up to a maximum of 150 per annum per residential postal address at a cost of £1.00 per permit per day of use. Unlimited additional visitors permits issued to the same residential postal address cost £2.00 per permit per day of use. No refunds will be made;
      • viii any resident whose usual place of abode is in All Souls Avenue (from Chamberlayne Road to Nos. 124 and 126 All Souls Avenue) may apply to the Council for the issue of a household visitor permit valid for use in the street for which it is issued for the period between 12.00 noon and 3.00 p.m. Mondays to Fridays at a cost of £100.00 per annum;
      • ix any person who occupies premises in any street in All Souls Avenue (from Chamberlayne Road to Nos. 124 and 126 All Souls Avenue) and who uses such premises for non-residential purposes may apply to the Council for the issue of a general business permit valid for use in existing permit holders parking places in the KH Zone and the parking places in All Souls Avenue. The charge for each general business permit will be £300 per annum (£160 for 6 months, £90 for 3 months). Existing KH zone business permits will now be valid for use in the parking places situated in All Souls Avenue (from Chamberlayne Road to Nos. 124 and 126 All Souls Avenue);
      • x any person who occupies premises in All Souls Avenue (from Chamberlayne Road to Nos. 124 and 126 All Souls Avenue) and who uses such premises for non-residential purposes may apply to the Council for the issue of a liveried vehicle business permit for any of its vehicles marked with the company livery for use in existing permit holders parking places in the KH Zone and the parking places in All Souls Avenue (from Chamberlayne Road to Nos. 124 and 126 All Souls Avenue). The charge for each liveried vehicle business permit will be £180 per annum (£100 for 6 months, £60 for 3 months). Existing KH zone liveried vehicle business permits will now be valid for use in the parking places situated in All Souls Avenue (from Chamberlayne Road to Nos. 124 and 126 All Souls Avenue);
      • xi permits issued by the Council to essential users or key workers will be valid for use in all the parking bays provided for resident and business users in the KH zone. The charge for an essential user permit or special permit will be £75 per annum;
      • xii any resident of a “car free” development as defined in a section 106 agreement made under the Town and Country Planning Act 1990 will not be eligible for a residents permit in the KH zone.

  • 3 The general effect of the ‘Waiting and Loading Restrictions’ Order will be further to amend the Brent (Waiting and Loading Restriction) Order 1979, so that:-
    • a waiting by vehicles (otherwise than for the purpose of delivering or collecting goods or loading or unloading a vehicle) will be prohibited at any time in certain lengths of All Souls Avenue;
    • b waiting by vehicles (otherwise than for the purpose of delivering or collecting goods or loading or unloading a vehicle) will be prohibited between 12.00 noon and 3 p.m. on Mondays to Fridays inclusive in certain lengths of All Souls Avenue;
    • c waiting by vehicles for the purpose of delivering or collecting goods or loading or unloading a vehicle for a period of more than 20 minutes in the same place will be prohibited between 12.00 noon and 3.00 p.m. on Mondays to Fridays inclusive in certain lengths of All Souls Avenue;
    • d the sale or offer for sale of goods from a vehicle will be prohibited unless there is in force a valid licence issued by the Brent Borough Council or the goods are immediately taken into or delivered at premises adjacent to the vehicle from which the sale is effected;
    • e the use of any vehicle or of any animal or the wearing of fancy dress or other costume, wholly or mainly for the purpose of advertising, will be prohibited;
    • f any existing prohibition on the waiting by vehicles, the sale or offer for sale of goods from a vehicle or the use of any animal or the wearing of fancy dress or other costume wholly or mainly for the purpose of advertising in certain lengths of the streets specified in All Souls Avenue, will be revoked.
  • 4 The prohibitions referred to in paragraph 3(a), (b) and (c) above will not apply in respect of anything done with the permission or at the direction of a police constable in uniform or in certain circumstances, e.g., the picking up or setting down of passengers; the carrying out of statutory powers or duties; the taking in of petrol, etc., from roadside petrol stations; to licensed street traders, etc. The usual exemption relating to vehicles displaying a disabled person’s “Blue Badge” will apply.
  • 5 The ‘Goods Vehicles Free Loading Places’ Order will be to:-
    • a designate free loading place in All Souls Avenue (outside No. 233) to operate between 8.30 a.m. and 6.30 p.m. on Mondays to Fridays inclusive (loading / unloading limited to 30 minutes, no return for one hour);
    • b specify that goods carrying vehicles constructed or adapted for use for the carriage of goods or burden of any description and is not drawing a trailer, may be used, subject to the provisions of the Order, for the purpose of continuous loading and unloading during the permitted hours.
  • 6 A copy of each of the Orders, which will come into operation on 6 April 2010, of a map of the relevant area and of relevant previous Orders can be inspected during normal office hours on Mondays to Fridays inclusive until the end of six weeks from the date on which the Orders were made at:-
    • a The One Stop Local Office, Brent Town Hall, Forty Lane, Wembley, Middx, HA9 9HX; and
    • b The One Stop Local Office, Brent House, 349-357 High Road, Wembley, Middx, HA9 6BZ.
  • 7 Copies of the Orders may be purchased from the address mentioned in paragraph 5(b) above.
  • 8 Any person desiring to question the validity of any of the Orders or of any provision contained therein on the grounds that it is not within the relevant powers of the Road Traffic Regulation Act 1984 or that any of the relevant requirements thereof or of any relevant regulations made thereunder has not been complied with in relation to any of the Orders may, within six weeks of the date on which the Orders were made, make application for the purpose to the High Court.
