PLANNING (LISTED BUILDINGS AND CONSERVATION AREAS) ACT 1990, SECTION 69
MIDDLEHAM CONSERVATION AREA
NOTICE IS GIVEN under the provisions of the 1990 Act that Richmondshire District Council has determined that the areas described in the Schedule to this Notice is an area of special architectural or historic interest, and that it is desirable to preserve or enhance its character or appearance. It has accordingly extended the Middleham Conservation Area, so as to include these areas.
The principal effects of these areas being included within a conservation area are as follows:
- 1 The Council is under a duty to prepare proposals to ensure the preservation or enhancement of the area.
- 2 Consent must be obtained from the Council for the demolition of any building in the area.
- 3 Special publicity must be given to planning applications for development in the area.
- 4 In carrying out any functions under the planning Acts (and, in particular, in determining applications for planning permission and listed building consent), the Council and the Secretary to State are required to take into account the desirability of preserving or enhancing the character of appearance of the area.
- 5 Six weeks’ notice must be given to the Council before works are carried out to any tree in the area.
SCHEDULE
- 1 The new boundary runs from the existing boundary at the west side of the footpath north of St Mary and Akelda’s Church along the fence and stone wall, at the rear of Kingsley House, north to Leyburn Road. The boundary then follows the back of the footway on the west side of Leyburn Road north to the junction with St Alkelda’s Road then the front boundary of the properties 1-8 The Busks and the stone wall field boundary to a point where it joins the garden boundary to The Busk Cottage opposite the stables. It then crosses the road to the north east to the back of the open spaces adjacent to the corner of the outbuildings/stables and follows the stone wall and post and rail fence south east and then south around the open space to the north residential boundary of The Busks. The boundary then follows the rear (north) garden boundaries of The Busks, Applegarth House, Auctioneer House, Windyridge, Wayside, Lowlands, Rurigene and Leesome Rise, east and then the side boundary of Leesome Rise south to join the original conservation area boundary at the north of the commercial garage/yard area off North Road. This includes the properties The Busks, Applegarth House, Auctioneer House, Windyridge, Wayside, Lowlands, Rurigene and Leesome Rise,
- 2 The new boundary runs from the original boundary on East Witton Road, continuing along the stone wall east and south east on the north side of the road following the stone wall to its junction with Straight Lane. It then follows the east side of Straight Lane south for approx 100m. At the junction with a footpath on the west it crosses Straight Lane westward and follows the field boundary west for the length of 1 field and rejoins the original boundary.
