TOWN AND COUNTRY PLANNING ACT 1990

THE SECRETARY OF STATE hereby gives notice that he has made an Order under Section 247 of the above Act entitled “The Stopping up of Highways (West Midlands) (No. 42) Order 2009” authorising the stopping up of an irregular shaped south eastern part width of Whitehouse Street comprising highway verge commencing from the junction of Whitehouse Street and Old Meeting Road and an irregular shaped western part width of Broad Street comprising lay-by and highway verge commencing 23 metres north east of the junction of Bayer Street and Broad Street, Coseley in the Metropolitan Borough of Dudley, to enable the development described in the Schedule to this notice to be carried out in accordance with planning permission granted Midland Heart Developments Ltd by Dudley Metropolitan Borough Council on 17 March 2009 under reference P08/1910.

COPIES OF THE ORDER MAY BE OBTAINED, free of charge, on application to the Secretary of State, addressed to the National Transport Casework Team, Government Office for the North East, Citygate, Gallowgate, Newcastle upon Tyne NE1 4WH (quoting reference NATTRAN/WM/S247/71) and may be inspected at all reasonable hours at Highways, Dudley Metropolitan Borough Council, The Council House, Mary Stevens Park, Stourbridge, West Midlands DY8 2AA.

ANY PERSON AGGRIEVED BY THE ORDER and desiring to question the validity thereof, or of any provision contained therein, on the ground that it is not within the powers of the above Act or that any requirement of that Act or of any regulation made thereunder has not been complied with in relation to the Order, may, within 6 weeks of the 7 DECEMBER 2009 apply to the High Court for the suspension or quashing of the Order or of any provision contained therein.

Planning permission is granted for the demolition of Wallbrook House and youth centre and redevelopment to form 72 apartment retirement village with communal facilities and associated car parking at land adjacent to Broad Street, Old Meeting Road and Whitehouse Street, Coseley, Dudley, West Midlands.
