- 1 NOTICE IS HEREBY GIVEN that the Council of the London Borough of Brent on 9 November 2009 made the above-mentioned Orders under sections 6, 45, 46, 49 and 124 of and Part IV of Schedule 9 to the Road Traffic Regulation Act 1984, as amended by section 8 of and Part 1 of Schedule 5 to the Local Government Act 1985, the Parking Acts of 1986 and 1989 and the Traffic Management Act 2004.
- 2 The general effect of the ‘Disabled Persons Parking Places’ Order will be to:-
- a designate parking places in certain lengths of the streets specified in Schedule 1 to this Notice in which vehicles authorised by the Order may be left for any period without charge;
- b provide that the parking places will operate “at any time”;
- c specify, in respect of the parking places, that disabled persons’ vehicles displaying in the relevant position a disabled person’s badge (commonly referred to as “the Blue Badge”) issued by any local authority under the provisions of the Disabled Persons (Badges for Motor Vehicles) (England) Regulations 2000 may be left therein;
- d provide that certain vehicles may wait in the parking places in certain circumstances, e.g., to allow persons to board or alight (maximum 2 minutes), to load or unload (maximum 20 minutes), etc;
- e change the existing times on disabled parking places to ‘at any-time’ outside Nos. 121, 186 / 188 and 220 to 244 Ealing Road and Stanley Close adjacent to No. 1 Stanley Avenue;
- f revoke existing disabled parking places outside No. 31A Crediton Road, NW10, No. 138 Shaftesbury Avenue, HA3 and No. 93 Victoria Road, NW6.
- 3 The general effect of the ‘Parking Places Amendment’ Orders will be to:-
- a reduce in length and redefine existing pay and display parking places and resident parking places in association with the provision of disabled persons parking places in Coronet Parade, Ealing Road, Furness Road, Minet Avenue, Newton Road (2 Nos.) Ranelagh Road, Ridley Road, Riffel Road and Wendover Road;
- b increase in length the existing resident parking places following the revocation of the no longer required disabled persons parking bays in Crediton Road and Victoria Road.
- 4 The general effect of the ‘Goods Vehicles Loading Places’ Order will be to increase in length and redefine existing free loading places in association with the provision of disabled persons parking places in Ealing Road.
- 5 The general effect of the Order will be further to amend the Brent (Waiting and Loading
Restriction) Order 1979, so that:-
- a waiting by vehicles (otherwise than for the purpose of delivering or collecting goods or loading or unloading a vehicle) will be prohibited at any time in the lengths of street specified in Schedule 2 to this Notice;
- b waiting by vehicles (otherwise than for the purpose of delivering or collecting goods or loading or unloading a vehicle) will be prohibited between 8.00 a.m. and 6.30 p.m. Mondays to Saturdays in the lengths of street specified in Schedule 3 to this Notice;
- c waiting by vehicles for the purpose of delivering or collecting goods or loading or unloading a vehicle for a period of more than 20 minutes in the same place will be prohibited between 11.00 a.m. and 6.30 p.m. throughout the week in the lengths of street specified in Schedule 2 to this Notice and between 11.00 a.m. and 6.30 p.m. on Mondays to Saturdays in the lengths of street specified in Schedule 3 to this Notice;
- d the sale or offer for sale of goods from a vehicle will be prohibited (except on Sundays in the lengths of street specified in Schedule 2 to this Notice) unless there is in force a valid licence issued by the Brent Borough Council or the goods are immediately taken into or delivered at premises adjacent to the vehicle from which the sale is effected;
- e the use of any vehicle or of any animal or the wearing of fancy dress or other costume, wholly or mainly for the purpose of advertising will be prohibited;
- f any existing prohibition on the waiting by vehicles, the sale or offer for sale of goods from a vehicle or the use of any vehicle or animal or the wearing of fancy dress or other costume wholly or mainly for the purpose of advertising in the lengths of streets specified in Schedules 2 and 3 to this Notice will be revoked.
- 6 A copy of each of the Orders, which will come into operation on 23 November 2009,
of maps of the relevant area, of the above-mentioned Orders of 1997, 2002, 2001, 2003,
2004 and 2008 (and of the Orders which have amended those Orders), can be inspected
during normal office hours on Mondays to Fridays inclusive until the end of six weeks
from the date on which the Orders were made at:-
- a The One Stop Local Office, Brent Town Hall, Forty Lane, Wembley, Middx, HA9 9HX; and
- b The One Stop Local Office, Brent House, 349 - 357 High Road, Wembley, Middx, HA9 6BZ.
- 7 Copies of the Orders may be purchased from the address mentioned in paragraph 5(b) above.
- 8 Any person desiring to question the validity of any of the Orders or of any provision contained therein on the grounds that it is not within the relevant powers of the Road Traffic Regulation Act 1984 or that any of the relevant requirements thereof or of any relevant regulations made thereunder has not been complied with in relation to any of the Orders may, within six weeks of the date on which the Orders were made, make application for the purpose to the High Court.
