Notice is hereby given that the Applicants presented an application to the High Court of Justice in the United Kingdom on 24 September 2009 (the “Application”) for an order under section 111 of Part VII of the Financial Services and Markets Act 2000 (the “Act”) sanctioning a scheme (the “Scheme”) for the transfer of the long-term insurance business of Hamilton Life to AVLAP and for an order under section 112(1) of the Act making ancillary provisions for implementing the Scheme.
Copies of the report by the Independent Expert (the “Report”) pursuant to section 109 of the Act and of a statement setting out the terms of the Scheme and a summary of the Report may be obtained, free of charge, by contacting Aviva, Hamilton Transfer Support Team in writing at PO Box 3491, Surrey Street, Norwich NR1 3FX, or by telephone on 0800 158 3468 (+ 44 1603 603894 if calling from outside the United Kingdom) between Monday and Friday 9.00 am to 6.00 pm and Saturday from 9.00 am to 5.30 pm from the date of publication of this notice until the date on which the Application will be heard before the Court. These documents can also be viewed on the website at www.hamiltontransfer.com.
The Application will be heard before a Judge of the Chancery Division, Companies Court, at the Royal Courts of Justice, The Strand, London WC2A 2LL, on 10 December 2009, and any person, including any policyholder or any employee of the Applicants, who claims that he would be adversely affected by the carrying out of the Scheme may appear at the time of the hearing in person or by Counsel or alternatively make written representation to Clifford Chance LLP using the details below. Any person who intends to appear, and any person who objects to the Scheme but does not intend to appear is asked to give notice in writing as soon as possible and preferably before 1 December 2009 of such intention or objection, and the reasons therefore, to Clifford Chance LLP, 10 Upper Bank Street, London E14 5JJ, United Kingdom.
