TOWN AND COUNTRY PLANNING ACT 1990
HIGHWAYS ACT 1980
THE SECRETARY OF STATE hereby gives notice that he has made two orders as follows:
- 1 An Order under Section 247 of the above Act entitled “The Stopping up of Highways (Yorkshire & The Humber) (No. 29) Order 2009” authorising the stopping up of lengths of Welbeck Street and Powell Street, a southern part width of Enterprise Way and an irregular shaped area covering Castleford Railway Station Platform and Car Park and;
- 2 An Order under Section 248 of the Town and Country Planning Act 1990 and Section 125 of the Highways Act 1980 entitled “The Stopping up of Highways (Yorkshire & The Humber) (No. 30) Order 2009” authorising the stopping up of lengths of Enterprise Way, Welbeck Street and Powell Street, the whole of Hope Street East, and a western part width of Station Road, and the stopping up of private means of access to premises and provision of new private means of access to premises, in relation to a main highway which is to be improved and constructed from a point just west of the junction of Enterprise Way and Booth Street and which extends in an easterly direction to where it will form a roundabout junction within the south east corner of Castleford Station and then extends northwards to join Station Road at a point just north and opposite the junction of Jessop Street, at Castleford, just north of Castleford Railway Station, in the Metropolitan District of the City of Wakefield, to enable the development described in the Schedule to this notice to be carried out in accordance with the planning permission granted to Metro by the City of Wakefield Metropolitan District Council on 2 March 2007 under reference 06/02349/FUL.
COPIES OF THE ORDERS AND RELEVANT PLANS MAY BE OBTAINED, free of charge, on application to the Secretary of State, addressed to the National Transport Casework Team, Government Office for the North East, Citygate, Gallowgate, Newcastle upon Tyne NE1 4WH (quoting reference NATTRAN/Y&H/S247/66 for the Section 247 Order and NATTRAN/Y&H/S248/67 for the Section 248 and 125 Order) and may be inspected at all reasonable hours c/o Sue Watton at Five Towns Centre, Welbeck Street, Castleford WF10 1DP.
ANY PERSON AGGRIEVED BY THE ORDER and desiring to question the validity thereof, or of any provision contained therein, on the ground that it is not within the powers of the above Act or that any requirement of that Act or of any regulation made thereunder has not been complied with in relation to the Order, may, within 6 weeks of the 9 July 2009 apply to the High Court for the suspension or quashing of the Order or of any provision contained therein.
