THE BRENT (PRESCRIBED ROUTES) (NO. 7) TRAFFIC ORDER 2009

  • 1 NOTICE IS HEREBY GIVEN that the Council of the London Borough of Brent on 29 June 2009 made the above-mentioned Orders under sections 6, 45, 46, 49 and 124 of and Part IV of Schedule 9 to the Road Traffic Regulation Act 1984 as amended by section 8 of and Part 1 of Schedule 5 to the Local Government Act 1985, the Parking Acts of 1986 and 1989 and the Traffic Management Act 2004.
  • 2 The general effect of the ‘Parking Places’ Order will be:
    • a to revoke and reduce in length the existing pay and display parking places in Montrose Crescent and Union Road;
    • b designate parking places that will operate between 8.00 a.m. and 6.30 p.m. Mondays to Saturdays in Station Grove specified in Schedule 1 to this Notice;
    • c specify that:
      • i each parking place may be used, subject to the provisions of the Order, for the leaving during the permitted hours of such vehicles as are passenger vehicles, goods carrying vehicles, motor cycles or invalid carriages displaying a valid parking ticket;
      • ii the maximum initial period for which a vehicle, displaying a valid parking ticket may be left during the permitted hours in the parking places will be 2 hours;
      • iii the charge for short term parking in the parking places will be 40 pence for 20 minutes, £1.00 for 40 minutes, £1.80 pence for 1 hour and £4.00 for 2 hours, the tickets for which will be issued by pay and display meters;
      • iv the interval before a vehicle may again be left in a parking place after the expiration of the period for which the initial charge was incurred will be 2 hours.
      ii the maximum initial period for which a vehicle, displaying a valid parking ticket may be left during the permitted hours in the parking places will be 2 hours; iii the charge for short term parking in the parking places will be 40 pence for 20 minutes, £1.00 for 40 minutes, £1.80 pence for 1 hour and £4.00 for 2 hours, the tickets for which will be issued by pay and display meters; iv the interval before a vehicle may again be left in a parking place after the expiration of the period for which the initial charge was incurred will be 2 hours.
  • 3 The general effect of the ‘Waiting and Loading Restrictions’ Order will be further to amend the Brent (Waiting and Loading Restriction) Order 1979, so that:
    • a waiting by vehicles (otherwise than for the purpose of delivering or collecting goods or loading or unloading a vehicle) will be prohibited at any time in certain lengths of streets specified in Schedule 2 to this Notice;
    • b waiting by vehicles for the purpose of delivering or collecting goods or loading or unloading a vehicle for a period of more than 20 minutes in the same place will be prohibited between 11.00 a.m. and 6.30 p.m. throughout the week in certain lengths of streets specified in Schedule 2 to this Notice;
    • c the sale or offer for sale of goods from a vehicle will be prohibited unless there is in force a valid licence issued by the Brent Borough Council or the goods are immediately taken into or delivered at premises adjacent to the vehicle from which the sale is effected;
    • d the use of any vehicle or of any animal or the wearing of fancy dress or other costume, wholly or mainly for the purpose of advertising, will be prohibited;
    • e any existing prohibition on the waiting by vehicles, the sale or offer for sale of goods from a vehicle or the use of any animal or the wearing of fancy dress or other costume wholly or mainly for the purpose of advertising in certain lengths of streets specified in Schedule 2 to this Notice, will be revoked.
  • 4 The prohibitions referred to in paragraph 3(a) and 3(b) above will not apply in respect of anything done with the permission or at the direction of a police constable in uniform or in certain circumstances, e.g., the picking up or setting down of passengers; the carrying out of statutory powers or duties; the taking in of petrol, etc., from roadside petrol stations; to licensed street traders, etc. The usual exemption relating to vehicles displaying a disabled person’s “Blue Badge” will apply.
  • 5 The general effect of the ‘Prescribed Routes’ Order will be to revoke one way working in Montrose Crescent between the south-western kerb-line of Copland Road and the south-western kerb-line of Station Grove imposed by the Brent (Prescribed Routes) Traffic Order 1970.
  • 6 A copy of each of the Orders, which will come into operation on 13 July 2009, of a map of the relevant area, of the above-mentioned Orders of 1970, 1979 (and of the Orders which have amended that Order) and 1999 can be inspected during normal office hours on Mondays to Fridays inclusive until the end of six weeks from the date on which the Orders were made at:
    • a The One Stop Local Office, Brent Town Hall, Forty Lane, Wembley, Middx, HA9 9HX; and
    • b The One Stop Local Office, Brent House, 349-357 High Road, Wembley, Middx, HA9 6BZ.
  • 7 Copies of the Orders may be purchased from the address mentioned in paragraph 6(b) above.
  • 8 Any person desiring to question the validity of any of the Orders or of any provision contained therein on the grounds that it is not within the relevant powers of the Road Traffic Regulation Act 1984 or that any of the relevant requirements thereof or of any relevant regulations made thereunder has not been complied with in relation to any of the Orders may, within six weeks of the date on which the Orders were made, make application for the purpose to the High Court.
