NOTICE OF CONFIRMATION BY AN ACQUIRING AUTHORITY OF A COMPULSORY PURCHASE ORDER

THE NORFOLK COUNTY COUNCIL (C441 BLOFIELD, BRUNDALL ROAD FOOTWAY) COMPULSORY PURCHASE ORDER 2008

THE HIGHWAYS ACT 1980 AND THE ACQUISITION OF LAND ACT 1981

  • 1 Notice is hereby given that the Secretary of State for the Department of Transport in exercise of his powers under the above Acts, on 9th October 2008 confirmed the Norfolk County Council (C441 Blofield, Brundall Road Footway) Compulsory Purchase Order 2008 submitted to him by the Norfolk County Council. No objections to the Order were received within the permitted period and consequently the Order was confirmed by the Secretary of State for the Department of Transport.
  • 2 The order as confirmed provides for the purchase for the purposes of—
    • a The improvement of the C441 Brundall Road Blofield by the provision of a footpath, and
    • b Use by the Acquiring Authority in connection with the improvement of the highway as aforesaid

of the land described in the Schedule.

  • 3 A copy of the order as confirmed by the Norfolk County Council and of the map referred to therein have been deposited at the offices of Norfolk County Council, County Hall, Martineau Lane, Norwich, NR1 2DH and may be seen at all reasonable hours.
  • 4 The order as confirmed becomes operative on the date on which this notice is first published. A person aggrieved by the order may, by application to the High Court within 6 weeks from that date, challenge its validity under section 23 of the Acquisition of Land Act 1981. The grounds for challenge can be that the authorisation granted by the order is not empowered to be granted or that there has been a failure to comply with any relevant statutory requirement relating to the order.

10 square metres – grass verge, embankment land adjoining the eastern boundary of C441 Brundall Road, Blofield (part of OS. TG3308 dated 2007)
