TOWN AND COUNTRY PLANNING ACT 1990

Notice is hereby given that Abernedd Power Company Ltd. (APCL) has applied to the Secretary of State for Business, Enterprise and Regulatory Reform (“DBERR) for consent to construct and operate a combined cycle power plant (CCPP) adjacent to the existing Baglan Bay Power Station (Grid Reference 273210, 192140). The installed capacity of the proposed generating station would be nominally 870MW.

Abernedd Power Company Ltd has also applied to DBERR for a direction under Section 90(2) of the Town and Country Planning Act 1990 that planning permission for the development be deemed to be granted.

A copy of the application with a plan showing the land to which it relates, together with a copy of the Environmental Statement discussing the proposals in more detail and presenting an analysis of the environmental implications, are available for inspection, free of charge, during normal office hours at:

In addition APCL will host an exhibition of the proposals on:

Monday 15 September 2008 at: Taibach Community Centre, Duke Street, Taibach, Port Talbot, SA13 1NA, between the hours of 11:00 and 20:00.

Tuesday 16 September 2008 at: Dalton Road Community Centre, Dalton Road, Sandfields, Port Talbot, SA12 6SL, between the hours of 11:00 and 20:00.

Any representations to the applications should be made in writing to the Secretary of State for Business, Enterprise and Regulatory Reform, c/o Bay 2123, 1 Victoria Street, London SW1H 0ET or by email to walter.gusmag@berr.gov.uk identifying the proposal and specifying any grounds for objection, not later than 8th October 2008. These representations to DBERR will be copied in full to the planning authority. All representations received will be published in full on the DBERR website at the end of this consultation period unless the individual requests otherwise.

During the consideration of the proposal the Secretary of State may formally request further information from the developer to supplement the Environmental Statement, and materially relevant additional information may also be generated. If that happens further public notices will give advice on how representations may be made to the Secretary of State on this material.

Following receipt of all views and representations the Secretary of State will either grant or refuse consent for the proposal (with or without conditions). This may involve holding a public inquiry first, depending on whether there is a statutory objection from the relevant planning authority, or the Secretary of State decides to exercise his discretion to call a public inquiry in the light of objection by other persons.
