ROYAL BOROUGH OF KENSINGTON AND CHELSEA – EXPERIMENTAL CHANGES TO WAITING RESTRICTIONS IN PELHAM STREET AND SYMONS STREET
THE KENSINGTON AND CHELSEA (WAITING AND LOADING RESTRICTIONS) (SPECIAL PARKING AREA) (NO. 1) EXPERIMENTAL TRAFFIC ORDER 2008

1. NOTICE IS HEREBY GIVEN that the Council of the Royal Borough of Kensington and Chelsea on 21st January 2008 made the above Order under sections 9 and 10 of the Road Traffic Regulation Act 1984, as amended.

2. The general effect of the Order will be to:—

(a) ban waiting by vehicles at any time in two lengths of the south side of Pelham Street, between its junctions with Fulham Road and Pelham Place/Thurloe Square (for distances of 30 metres and 28 metres) and in a length of the south-east side of Symons Street directly north-east of it’s junction with Cadogan Gardens (for a distance of 32 metres); and

(b) ban waiting by vehicles between 8.30am and 6.30pm on Mondays to Saturdays inclusive in a length of the north side of Pelham Street outside No. 91 Pelham Street (for a distance of 17 metres).

(The existing bans on waiting by vehicles in the lengths of roads described above would be suspended, and waiting for the purpose of loading or unloading a vehicle would be permitted, subject to certain time limits and conditions.)

3. The Order is necessary to prevent obstructive parking and thereby improve the flow of traffic in Pelham Street at all times, whilst still allowing parking at certain times of the day where it will not impede the flow of traffic. The Order will also prevent parking in Symons Street where this prevents loading and unloading to premises. These restrictions are being introduced by way of an experiment to allow the Council to assess their effect and make any changes necessary at short notice, before deciding whether to make them permanent.

4. The Order will come into operation on 31st January 2008 and may continue in operation for up to 18 months. Where it appears necessary for certain purposes, the Order or any of its provisions may be modified or suspended, while the Order is in force.

5. A copy of the Order and of documents giving more detailed particulars of the Order are available for inspection at the Town Hall, Hornton Street, London W8 7NX, during normal office hours on Mondays to Fridays inclusive, until the Order ceases to have effect.

6. The Council will be considering in due course whether the provisions of the Order should be continued indefinitely by means of an Order made under section 6 of the Road Traffic Regulation Act 1984. Any person may object to the making of this Order for the purpose of such indefinite continuation within a period of six months beginning with the day on which the Order comes into operation, or, if the Order is varied by any other Order or modified pursuant to section 10(2) of the 1984 Act, beginning with the day on which the variation or modification or the latest variation or modification came into operation. Any such objection must be in writing and must state the grounds on which it is made and be sent to the Council’s agents in this matter, the Project Centre, Saffron Court, 14b St. Cross Street, London EC1N 8XA, quoting reference PCL/TMO/ZAP/3222390122, by 30th July 2008.

7. Under the Local Government (Access to Information) Act 1985, any letter you write in response to this Notice may be made available to the press and to the public, who would be entitled to take copies of it if they so wished.

8. any person wishes to question the validity of the Order or of any of its provisions on the grounds that it or they are not within the powers conferred by the Road Traffic Regulation Act 1984, or that any requirement of that Act or of any instrument made under that Act has not been complied with, that person may, within 6 weeks from the date on which the Order is made, apply for the purpose to the High Court.
