INTRODUCTION OF “PAY BY PHONE” PARKING FACILITIES CONTROLLED PARKING ZONES A, B, C, D, F AND H

1. NOTICE IS HEREBY GIVEN that Westminster City Council on 17th October 2007 made the following Orders under sections 45, 46, 49 and 124 of and Part IV of Schedule 9 to the Road Traffic Regulation Act 1984 as amended by the Local Government Act 1985:

• The City of Westminster (Parking Places) (Further Provisions) (A98 Zone) (No. 11) Order 2007;

• The City of Westminster (Parking Places) (Further Provisions) (A00 Zone) (No. 12) Order 2007;

• The City of Westminster (Parking Places) (Further Provisions) (B Zone) (No. 13) Order 2007;

• The City of Westminster (Parking Places) (Further Provisions) (C Zone) (No. 14) Order 2007;

• The City of Westminster (Parking Places) (Further Provisions) (D Zone) (No. 15) Order 2007;

• The City of Westminster (Parking Places) (Further Provisions) (F Zone) (No. 16) Order 2007; and

• The City of Westminster (Parking Places) (Further Provisions) (H Zone) (No. 17) Order 2007.

2. The general effect of the Orders will be to:

(a) provide that payment of the parking charge at metered, “pay and display” and “shared use” parking places throughout controlled parking zones A, B. C, D, F and H may be made, where available, using “pay by phone” technology (via connection with the Council’s service provider);

(b) user instructions will be displayed at each parking place where the “pay by phone” payment facility is available;

(c) the parking charge and maximum parking period, etc., at each parking place where the “pay by phone” payment facility is available will remain unchanged;

(d) the facility will provide an alternative method of payment at certain parking places. If only one method of payment is available at a parking place (i.e. cash, debit/credit card or “pay by phone”) that method must be used; and

(e) the existing exemption from payment of the parking charge at “out of order” parking meters and “pay and display” machines will be removed.

3. The Orders, which will come into force on 22nd October 2007, and other documents giving more detailed particulars of the Orders are available for inspection between 9 a.m. and 5 p.m. on Monday to Fridays inclusive at West One, 59 Buckingham Gate, London, SW1E 6AJ, until 28th November 2007.

4. Any person desiring to question the validity of the Orders or of any provision contained therein on the grounds that it is not within the relevant powers of the Road Traffic Regulation Act 1984 or that any of the relevant requirements thereof or of any relevant regulations made thereunder has not been complied with in relation to the Orders may, within six weeks from the date on which the Orders were made, make application for the purpose to the High Court.
