PLANNING (LISTED BUILDINGS AND CONSERVATION AREAS) ACT 1990
EXTENSION TO THE WILSHAW CONSERVATION AREA

Notice is given under the Planning (Listed Buildings and Conservation Areas) Act 1990 Section 69 that the Kirklees Metropolitan Council have on the 28 March 2007 determined that the area described in the Schedule to this Notice is an area of special architectural or historic interest the character of which it is desirable to preserve or enhance and has therefore designated this area as an extension of the Wilshaw Conservation Area.

1. Conservation area consent will now be required for the demolition of all unlisted buildings (other than excepted buildings) in the area.

2. Planning applications for development which would in the opinion of the local planning authority affect the character or appearance of the conservation area must be given publicity and representations received as a result of the publicity must be taken into account in determining the application.

3. It becomes an offence, subject to certain exceptions to cut down, top, lop, uproot, wilfully damage or wilfully destroy any tree in the area except with the consent of the local planning authority.

4. The local planning authority are now under a duty to formulate and publish proposals for the preservation and enhancement of the area.

Wilshaw Conservation Area

Approximate Size: 14.98 hectares

Description of the revised boundary:-

Starting at the south-west corner of the south curtilage boundary of number 15 Wilshaw Road at the junction of Wilshaw Road with Wilshaw Mill Road, the Wilshaw Conservation Area boundary runs east and includes the boundary walls of 15 to 31 Wilshaw Road. The boundary then follows a northward path intersecting the property known as Cherry Tree Lodge (31a and 31b Wilshaw Road) and continues towards the field boundary. The Wilshaw conservation area boundary travels west and terminates at the north curtilage boundary of number 27 Wilshaw Road. From here the boundary changes course and heads in a northward direction for approximately 100 metres before heading off toward the north curtilage of Gill Birks Farm. The boundary intersects the north curtilage boundary of Gill Birks Farm, excluding the outbuilding at the Farm. From here it traverses the field towards Greave Dike where it continues in an eastward direction following the north curtilage field boundary of Manor Farm at Lower Greave. The boundary continues and travels along the north curtilage boundary of Manor House Barn where it turns south-east, following the field boundary, continuing past the playing field and traverses the east curtilage boundary of St Mary’s Court.

The Wilshaw conservation area boundary crosses Wilshaw Road at the junction of Wilshaw Road and the west curtilage boundary of Bell View Convalescent Home. The boundary crosses the road in a south-eastward direction where it continues along the field boundary opposite. The boundary then continues past the south curtilage boundary of the water reservoir (previously supplying Wilshaw Mill), and on towards the junction of Wilshaw Mill Road, past the south curtilage boundary of the Trough. At the Wilshaw Mill Road junction the boundary continues across the road and includes the boundary walls as it turns in a south-west direction along the perimeter of Wilshaw Mill Road. The boundary runs past the south-west curtilage boundary of 19 to 25 Wilshaw Mill Road and terminates at the south-west corner of the south curtilage boundary of 15 Wilshaw Road.

The new Wilshaw Conservation Area boundary includes the whole of the former conservation area boundary. There are no new addresses to be excluded or included.
