HIGHWAYS AT CHELMSLEY WOOD TOWN CENTRE

THE SECRETARY OF STATE hereby gives notice that he has made an Order under Section 247 of the above Act entitled “The Stopping up of Highways (Metropolitan Borough Of Solihull) (No.1) Order 2007” authorising the stopping up of highways at Chelmsley Wood Town Centre and requiring the provision of new highway shown as stippled on the deposited plan, new means of access shown as thin diagonal hatching, new footpaths, bridleways and cyclepaths shown as thick vertical hatching, and the improvement of existing highway shown as cross hatched on the deposited plan.

THE ORDER as made, will authorise the Stopping Up only to enable the development described in the Schedule to this notice to be carried out in accordance with the planning permission granted by Solihull Metropolitan Borough Council on 12 May 2004 under reference 2003/2582.

Copies of this Order may be obtained, free of charge on application to the Government Office for the West Midlands at the offices of the Director, Sustainable Futures Directorate, 5 St. Philip’s Place, Colmore Row, Birmingham, B3 2PW (quoting reference: 5108/35/1/8) and may be inspected at all reasonable hours at the offices of Chelmsley Wood Library, Stephenson Drive, Chelmsley Wood, Solihull, B37 5TA.

ANY person aggrieved by the Order and desiring to question the validity thereof, or of any provision contained therein, on the grounds that it is not within the powers of the above Act or that any requirement of that Act or of any regulation made thereunder has not been complied with in relation to the Order, may within 6 weeks of the 18 April 2007 apply to the High Court for the suspension or quashing of the Order or of any provisions contained therein.

THE SCHEDULE

Demolition of Public Library; Banbury Club; National Probation Service Offices; Existing decorative canopies within malls and South West corner of the existing shopping centre. Erection of new food retail unit (Use Class A1), up to 7,243 sq.m (gross internal GI) plus 1,600 sq.m ancillary service yard; New, 3,058 sq.m stand alone, non food retail unit (use Class A1), up to 3,058 sq.m (GI); New retail units within the existing malls and new Western mall as a result of alterations to existing layout (Use Classes A1,A2 and A3), this will result in net increase in retail floor space of 500 sq. m (GI); Public access, circulation and amenity space; New Local Authority office space to include private offices and public meeting areas (Use Classes A2 and B1a), up to 2,797 sq. m(GI) (To include 644 sq. m of relocated housing office and Social Services office space); Relocation of the Public Library (Use Class D1) up to 1,688 sq. m (GI) to include multi function space; Relocation of the Probation Centre

(Use Class A2) up to 872 sq. m (GI); Refurbishment of existing malls, to include replacement paving and canopies; New North entrance feature to the shopping centre; New car park for up to 525 vehicles, including disabled parking, mother and baby parking and secure cycle storage. Associated highways works to include removal of one pedestrian bridge and partial removal of second pedestrian bridge to be replaced with “At Grade Crossings” and reconfiguration of the local road network immediately in and surrounding the town centre to accommodate bus interchange and limited bus “layover” provision.
