KINGSTON ROAD AREA

1. Notice is hereby given that the London Borough of Merton, after consulting the Commissioner of Police of the Metropolis, has made the above mentioned Orders under sections 6 and 124 of and Part IV of Schedule 9 to the Road Traffic Regulation Act 1984 (as amended) and the Road Traffic Act 1991. The Orders were made on the 21 March 2007 and shall become operational on the 23 March 2007. 2. The general effects of this Orders is: (a)  to further amend the London Borough of Merton (Waiting and Loading Restrictions) Order, 1977 so that waiting restrictions be introduced in the roads detailed in the Schedule 1 to this Notice, operating at all times; (b) to introduce limited waiting parking spaces in Kingston Road as detailed in Schedule 2 to this Notice. 3. Nothing in the Orders will apply to anything done with the permission or at the direction of a police constable in uniform. 4. Exemptions are provided in Article 2(a) to permit vehicles to wait: (a) to enable passengers to board or alight and to load or unload their personal luggage; (b) if they are being used to maintain the road or the services therein or by local authorities or the Post Office in pursuance to statutory powers and duties; (c) if they are being used for police, fire brigade or ambulance purposes. 5. A copy of the Orders, a plan identifying the area affected by the Orders and the Council’s Statement of Reasons for making the Orders can be inspected during the Council’s normal office hours Mondays to Fridays at the Merton Link, Merton Civic Centre, London Road, Morden, Surrey. 6. Any person desiring to question the validity of the Orders or of any provision contained therein on the grounds that it is not within the relevant powers of the Act, or that any of the relevant requirements of the Act, or of any relevant regulations made under that Act have not been complied with in relation to the Orders may, within six weeks from the date on which the Orders were made, make an application for the purpose to the High Court. SCHEDULE 1 Waiting Restrictions—operating at all times Kingston Road (i) North side from a point 10m east of the eastern kerbline of Oxford Avenue westwards for a distance of 28m. from a point 10m east of the eastern kerbline of Rothesay Avenue westwards for a distance of 21m. Kingston Road (ii) South side from a point 20m east of the eastern kerbline of Cannon Hill Lane to a point 20m west of the western kerbine of Cannon Hill Lane from the western kerbline of Church Lane eastwards for a distance of 10m. Oxford Avenue from its junction with Kingston Road northwards for a distance of 8m. Cannon Hill Lane from its junction with Kingston Road southwards for a distance of 20m. Church Lane from its junction with Kingston Road southwards for a distance of 18m. SCHEDULE 2 Limited waiting, 30 minutes no return within 1 hour, operating Monday to Saturday, 9am to 3pm Kingston Road (i) North side from a point 10m west of the western kerbline of Oxford Avenue westwards for a distance of 23m. from a point 10m east of the eastern kerbline of Oxford Avenue eastwards for a distance of 36m. from a point 10m east of the eastern kerbline of Chase Side Avenue to a point 11m west of the western kerbline of Rothesay Avenue. Kingston Road (ii) South side from a point 8m east of the common boundary of 288 and 290 Kingston Road eastwards for a distance of 12m.
