THE DIVERSION OF HIGHWAYS (FFOS-Y-FRAN LAND RECLAMATION SCHEME, MERTHYR TYDFIL) ORDER 200

Notice is hereby given that the Minister for Enterprise, Innovation and Networks acting on behalf of the National Assembly for Wales proposes to make an Order under section 247 of the Town and Country Planning Act 1990 to authorise the diversion of the section of highway described in Schedule 1 to this notice. If the Order is made, the diversion will be authorised only in order to enable development being the Ffos-y-Fran Land Reclamation Scheme which involves the reclamation of derelict land and recovery of coal by opencast methods, to be carried out in accordance with planning permission granted by the National Assembly for Wales on 11 April 2005 under Ref A-PP152-07-014 described in Schedule 4 to this notice. The Order will cease to have effect if the planning permission expires or is revoked. The Order requires the provision of a new highway described in Schedule 2 to this notice and the improvement of an existing highway described in Schedule 3 to this notice, which will be highways maintainable at public expense, for which Merthyr Tydfil County Borough Council shall be the Highway Authority. During the 28 days from 15 March 2007, copies of the draft Order and the deposited plan may be inspected, free of charge, at the offices of Merthyr Tydfil County Borough Council, Castle Street, Merthyr Tydfil, during normal office hours or may be obtained, free of charge, from the address below quoting the Welsh Assembly Government reference. Within the above mentioned period of 28 days, any person may, by notice to the Welsh Assembly Government, Transport Wales, Transport Planning and Administration Division 3, Cathays Park, Cardiff CF10 3NQ (quoting Ref CZ510-5-52-1), object to the making of the Order. In the preparation of an objection, it should be borne in mind that the substance of any objection or representation may be communicated to other people who may be affected by it. That length of highway known as “Bogey Road”, which passes over the Merthyr and Gelligaer Urban Common at Merthyr Tydfil, which commences from point “A” on the deposited plan (numbered MMAG.RC.01W) and extends for a distance of approximately 683 metres in a generally north-easterly direction to point “C” on the deposited plan (numbered MMAG.RC.01W). Schedule 2 Description of the area of new highway to be provided. A new highway to be provided to the north-west of the existing highway known as “Bogey Road” that commences from point “A” on the deposited plan (numbered MMAGRC01W) and extends in a generally north-easterly direction to point “C” on the deposited plan (numbered MMAGRC01W). Schedule 3 Length of highway to be improved. That length of highway known as “Bogey Road” which passes over the Merthyr and Gelligaer Urban Common at Merthyr Tydfil, which commences from point “D” on the deposited plan (numbered MMAGRC01E) and extends for a distance of approximately 272 metres in a generally easterly direction to point “E” on the deposited plan (numbered MMAGRC01E).
