THE BOROUGH COUNCIL OF SANDWELL (WATERY LANE CANAL BRIDGE) SCHEME 2003

THE SECRETARY OF STATE for Transport hereby gives notice that he has confirmed with modifications the above Scheme which was made by the Borough Council of Sandwell under section 106(3) of the Highways Act 1980 and which, as confirmed, authorises the Council to construct as part of the improved highway between Queens Road and Alexandra Road, Tipton, West Midlands, a bridge over the navigable waters of the Birmingham Canal in the Borough of Sandwell. COPIES of the Scheme (as confirmed) and of the relevant plan and specifications may be inspected free of charge at all reasonable hours at the offices of the Head of Legal Services, Sandwell Council House, Freeth Street, Oldbury, West Midlands B69 3DE. COPIES of the instrument of confirmation of the Scheme, which is entitled “The Borough Council of Sandwell (Watery Lane Canal Bridge) Scheme 2003 Confirmation Instrument 2007” and which contains a copy of the Scheme as confirmed SI No 11, can be purchased, price £3.00, either through booksellers or direct from Government bookshops (The Stationery Office). ANY PERSON aggrieved by the Scheme and desiring to question the validity thereof, or of any provision contained therein, on the ground that it is not within the powers of the Highways Act 1980 or on the ground that any requirement of that Act or of any regulations made thereunder has not been complied with in relation to the Scheme, may, within 6 weeks of the 18 January 2007, apply to the High Court for the suspension or quashing of the Scheme or of any provision contained therein.
