Notice is hereby given that a public local inquiry into this matter will be held by Ms C Downs BSc DipTP MRTPI at Portsmouth Guildhall, Guildhall Square, Portsmouth, on Tuesday 27 February 2007, at 10.00 am. 1. Whereas Ashurst on behalf of Portsmouth City Council have submitted to the Secretary of State for Communities and Local Government for confirmation an Order made by them under section 226(1)(a) of the Town and Country Planning Act 1990, section 13 of the Local Government (Miscellaneous Provisions) Act 1976 and the Acquisition of Land Act 1981, which would authorise them to acquire compulsorily the land referred to in the Schedule hereto for the purposes of facilitating the carrying out of a comprehensive scheme of redevelopment (including retail, residential, leisure, hotel accommodation together with car parking and alterations to the highway network) and new rights over land described in the Schedule hereto. A copy of the Order and of the map referred to therein are on deposit at the Help Desk, Civic Offices, Guildhall Square, Portsmouth, and may be seen there, on application at all reasonable hours. In addition these documents are available on the Council’s website www.portsmouth.gov.uk 2. Whereas the Secretary of State for Transport has published his intention to make an Order under section 247 of the Town and Country Planning Act 1990, authorising the stopping-up of highway referred to in the Schedule, to enable development authorised by outline planning permission granted to The Development Planning Partnership, on behalf of Centros Miller Portsmouth Ltd Partnership, by Portsmouth City Council on 20 July 2006, under Ref A*39165/AA. If authorised, the stopping-up Order would remove all rights of way by the public over the highway specified below. In respect of the following land the right for Portsmouth City Council and all persons authorised on its behalf to enter and carry out any works necessary for the construction, alteration and use of the development of the land to be acquired and/or any such accommodation and other works as may be necessary for the alteration or adaptation of the rear of the premises in order to render them compatible with the development of the land to be acquired including (but not limited to) the removal of the existing canopy and subsequent works of making good, alterations to or replacement of services, drainage, rear access and emergency escape, alterations to the fire resistance of the rear facade of the premises, the erection of scaffolding and temporary hoardings for construction purposes and any other rights or works necessary to facilitate access to the premises to carry out any of the above works along with the right to oversail with cranes: Cascades Shopping Centre: Northern part of Cascades Shopping Centre (excluding Marks and Spencer) comprising part of common areas, part of Units 2-17, part of multi-storey car park and first floor overhang. In respect of the following land the right for Portsmouth City Council and all persons authorised on its behalf to enter and carry out any works necessary for the construction, alteration and use of the development of the land to be acquired and/or any such accommodation and other works as may be necessary for the alteration or adaptation of the rear of the premises in order to render them compatible with the development of the land to be acquired including (but not limited to) alterations to or replacement of services, drainage, rear access, servicing arrangements and emergency escape, alterations to the fire resistance of the rear facade of the premises, the erection of scaffolding and temporary hoardings for construction purposes and any other rights or works necessary to facilitate access to the premises to carry out any of the above works along with the right to oversail with cranes: Cascades Shopping Centre: Northern and eastern part of retail unit occupied by Marks and Spencer comprising 163-173 Commercial Road. In respect of the following land the right for Portsmouth City Council and all persons authorised on its behalf to enter and carry out any works necessary for the construction, alteration and use of the development of the land to be acquired and/or any such accommodation and other works as may be necessary for the alteration or adaptation of the rear of the premises and the car park and service yard in order to render them compatible with the development of the land to be acquired including (but not limited to) alterations to or replacement of services, drainage, rear access and emergency escape, alterations to the rear fac"ade of the premises, underpinning the existing premises, the erection of scaffolding and temporary hoardings for construction purposes and any other rights or works necessary to facilitate access to the premises to carry out any of the above works along with the right to oversail with cranes: Sainsbury’s: Sainsbury’s supermarket, bank, part of the car park and service yard. Schedule 2 Stopping-up Order The areas of highway to be stopped up (23 sections in total) are at Portsmouth City North (Charlotte Street, Brewer Street, Cascades Approach, Marketway, Commercial Road, South Link Road, Cornmill Street, Lake Road, Eden Street, Toby Street, Landport View, Pan Street, Pye Street, Providence Place, Providence Path, Frederick Street, Sussex Place, Clarence Street, Fitzherbert Street and subway under Cornmill Street), Landport, Portsmouth, Hampshire.
