SECTION 116 HIGHWAYS ACT 1980
NOTICE OF APPLICATION FOR AN ORDER STOPPING-UP AND DIVERSION OF HIGHWAY AT KENTON LANE, NEWCASTLE UPON TYNE
Notice is hereby given that the Council of the City of Newcastle upon Tyne intends to apply to the Magistrates’ Court under section 116 of the Highways Act 1980, for an Order stopping-up and diverting the following areas of highway on plan Ref TM.K25.030 (“the Drawing”); the area to be stopped up is more particularly delineated hatched blue on the Drawing and described in Article 1 below (“the Existing Route”) and the diverted route is more particularly defined hatched red on the Drawing and described in Article 2 below (“the Diverted Route”) and diversion of the Existing Route is being made to the Diverted Route on the grounds that the Diverted Route is nearer or more commodious to the public. 1. Highway to be stopped up The existing highway between points A and B on the Drawing which runs northwards then eastwards then northwards from the existing access road to the east of Manor House Farm Cottages, Kenton Lane, between the main Kenton School site and the adjacent playing fields to the west of the school. Point A being located 29.5 metres east and 20 metres north of the north-west corner of number 6 Manor House Farm Cottages, Kenton Lane, and point B being located 28 metres west of 375 metres north of the north-west corner of number 6 Manor House Farm Cottages, Kenton Lane. The highway is 415 metres long and varies in width between 2 metres and 20 metres throughout. 2. Route of diversion Proposed diverted highway to be provided between points A and C on the Drawing, which will run northwards from the existing access road to the east of Manor House Farm Cottages. Point A being located 29.5 metres east and 20 metres north of the north-west corner of number 6 Manor House Farm Cottages, Kenton Lane, and point C being located 20 metres west and 380 metres north of the north-west corner of number 6 Manor House Farm Cottages, Kenton Lane. The highway is 370 metres long and 2.5 metres wide throughout. 3. The application is to be heard on Tuesday 28 November 2006, at 2.15 pm, in Gosforth Magistrates Court, Newcastle upon Tyne. 4. The effect of the Order sought will be to prevent all traffic and pedestrians over the Existing Route once the Diverted Route has been created to the satisfaction of two justices of the peace and the Order may be inspected, free of charge, at the Customer Service Centre, Civic Centre, Newcastle upon Tyne, between 8.30 am and 4.30 pm, Mondays to Fridays.
