HIGHWAYS ACT 1980
THE LONDON TO FISHGUARD TRUNK ROAD (A40) (LLANSANTFFRAED, TALYBONT-ON-USK JUNCTION IMPROVEMENT SIDE ROADS) ORDER 2006
Notice is hereby given that the Minister for Enterprise Innovation and Networks, acting
on behalf of the National Assembly for Wales, has made an Order under sections 14,
125 and 268 of the Highways Act 1980. The effect of the Order is:
(a)(i) to improve, raise or otherwise alter highways;
(ii) to stop up a highway;
(iii) to construct a new highway;
(iv) to stop up private means of access to premises; and
(v) to provide new means of access to premises,
all in the vicinity of the route of the London to Fishguard Trunk Road (A40) at Llansantffraed
in the county of Powys; and
(b) provide for the transfer of the said new highway to the Powys County Council
as from the date the National Assembly for Wales notifies the Council that the new
highway has been completed and is open for through traffic.
Copies of the Order and the relevant map may be inspected, free of charge, at all
reasonable hours from 28 June 2006 until 9 August 2006, or within 6 weeks from the
date of publication of this notice, whichever period expires later, at the Welsh Assembly
Government, Transport Wales, Transport Planning and Administration Division 3, Cathays
Park, Cardiff CF10 3NQ; the offices of Powys County Council, County Hall, Spa Road
East, Llandrindod Wells, Powys LD1 5LG; and at the Talybont-on-Usk General Store,
Talybont-on-Usk, Brecon LD3 7YJ.
Copies of the Order, the title of which is “The London to Fishguard Trunk Road (A40)
(Llansantffraed, Talybont-on-Usk Junction Improvement Side Roads) Order 2006”, can
be obtained from the Welsh Assembly Government, Transport Wales, Transport Planning
and Administration Division 3, Cathays Park, Cardiff CF10 3NQ.
Any person aggrieved by the Order and desiring to question the validity thereof,
or of any provision contained therein, on the ground that it is not within the powers
of the Highways Act 1980, or on the ground that any requirement of that Act, or of
regulations made thereunder, has not been complied with in relation to the Order may,
within 6 weeks from 28 June 2006, or within 6 weeks from the date of publication of
this notice if such period shall expire later, apply to the High Court for the suspension
or quashing of this Order or of any provision contained therein.
