COMPULSORY PURCHASE ORDER (NO MP 26) 2006
COMPULSORY PURCHASE OF LAND AND NEW RIGHTS IN THE CITY OF CHESTER IN THE COUNTY OF CHESHIRE
1. Notice is hereby given that the Secretary of State for Transport in exercise of his powers conferred on him by the above Acts, on 25 May 2006, made the A550 and A5117 Trunk Roads (Improvement between M56 and A548) and Connecting Roads Compulsory Purchase Order (No MP 26) 2006. 2. The Order as made provides for the purchase of: (a) the land and rights described in the schedule hereto for the purpose of: (i) the construction of the new trunk road and connecting roads in the Parishes of Shotwick Park, Puddington and District, Saughall, Mollington, Lea-by-Backford, in the City of Chester in the County of Cheshire in pursuance of the A550 and A5117 Trunk Roads (Improvement between M56 and A548) and Connecting Roads Order 2006. (ii) the construction and improvement of highways and the provision of new means of access to premises in the Parishes of Shotwick Park, Puddington and District, Saughall, Mollington, Lea-by-Backford in the City of Chester in the County of Cheshire in pursuance of the A550 and A5117 Trunk Roads (Improvement between M56 and A548) and Connecting Roads (Side Roads) Order 2006. (iii) the mitigation of any adverse effect which the existence or use of certain of the highways proposed to be constructed or improved by the Secretary of State for Transport as mentioned in this article will have on their surroundings. (iv) use by the Secretary of State in connection with such construction and improvement of highways. 3. Copies of the Compulsory Purchase Order as made by the Secretary of State for Transport and of the maps referred to therein, together with copies of the above-mentioned Trunk Road Order and Side Roads Order all with their accompanying plans, have been deposited and may be seen at all reasonable hours from 9th June 2006 to 21st July 2006 at the offices of: Highways Agency, City Tower, Piccadilly Plaza, Piccadilly, Manchester, M1 4BE; and at Cheshire County Council, Backford Hall, Chester, CH1 6EA; Chester City Council, Town Hall, Chester, CH1 2HS; Woodvale Stores, Church Road, Saughall, Chester, CH1 6EN. 4. The order as made becomes operative on the date on which this notice is first published: but a person aggrieved by the order may, by application to the High Court within 6 weeks from the operative date, question its validity on the grounds: (i) that the authorisation granted by the order is not empowered to be granted, or (ii) that their interests have been substantially prejudiced by failure to comply with any statutory requirement relating to the order.
