TRAFFIC MANAGEMENT ORDER 2006/010
THE SOUTHWARK (BOX JUNCTIONS) TRAFFIC MANAGEMENT ORDER 2006/010 RELATING TO HALF MOON LANE
Made: 30 January 2006. Coming into operation: 21 February 2006. The Council of the London Borough of Southwark, having consulted the Commissioner of Police of the Metropolis, in exercise of the powers conferred by section 6 of the Road Traffic Regulation Act 1984, as amended by the Local Government Act 1985, and of all other powers thereunto enabling hereby make the following Order: 1. This Order shall come into operation on 21 February 2006 and may be cited as the Southwark (Box Junctions) Traffic Management Order 2006/010. 2. In this Order, unless the context otherwise requires: “the boxed area” means three areas of carriageway in the London Borough of Southwark. (i) Being an area at or adjacent to the junction of Half Moon Lane and Beckwith Road which is marked by cross-hatched yellow lines bounded by a yellow line placed on the carriageway. “enactment” means any enactment, whether public, general or local, and includes any order, bye-law, rule, regulation, scheme or other instrument having effect by virtue of an enactment and any reference in this Order to any enactment shall be construed as a reference to that enactment as amended, applied, consolidated, re-enacted by or as having effect by virtue of any subsequent enactment. 3. No person shall drive a vehicle into the boxed area and thereafter drive it in such a direction that it becomes necessary, owing to the presence of one or more other vehicles in or near to that area, for any part of the vehicle to remain at rest within the area. No driver of a vehicle which is caused to remain at rest within the area shall be guilty of an offence if at the time he drove into the area they had reasonable cause to believe that they would immediately thereafter be able to drive the vehicle wholly out of the area. 4. Noting in Article 3 of this Order shall apply: (a) to any person driving a vehicle entering the box from Herne Hill with the intention of turning right into Half Moon Lane; or (b) in relation to vehicles used for ambulance, fire or police purposes; or (c) to anything done with the permission or at the direction of a Police Constable in uniform. 5. The prohibitions imposed by this Order are in addition to and not in derogation of any restrictions, prohibition or requirement imposed by any other enactment and any exception or exemption from the provisions of this Order is without prejudice to the provisions of any other enactment.
