ROAD TRAFFIC REGULATION ACT 1984
THE A4123 TRUNK ROAD (WOLVERHAMPTON ROAD) (PROHIBITION AND RESTRICTION OF WAITING) ORDER 2006
The Secretary of State for Transport hereby gives notice that he has made an Order under sections 1(1), 2(1) and (2), and 4(1) and (2) of, and paragraph 27(1) of Schedule 9 to, the Road Traffic Regulation Act 1984 on the A4123 Trunk Road in the Metropolitan Borough of Sandwell. The effect of the Order, which comes into force on 18 January 2006, will be to prohibit vehicles from waiting on lengths of the service road adjacent to the west side of the A4123 Wolverhampton Road at its junction with the A456 Hagley Road West and will: (a) prohibit vehicles from waiting at any time on: (i) the east side of the service road, and (ii) the west side of the service road from a point 21 metres north of the centre point of the southern junction of the service road with Wolverhampton Road to the northern junction of the service road with Wolverhampton Road; (b) prohibit vehicles from waiting for a period exceeding two hours, with no return within one hour, on the west side of the service road from its junction with the footway of A456 Hagley Road West to a point 21 metres north of the centre point of the southern junction of the service road with Wolverhampton Road. Exemptions will be provided which will include emergency vehicles, delivery and service vehicles, disabled person’s vehicles and vehicles being used in connection with any building operation or demolition, the removal of any obstruction to traffic or the maintenance of the road or the services therein. The Order also consolidates various Prohibition of Waiting Orders currently in force on the A4123 Wolverhampton Road within the Metropolitan Borough of Sandwell. A copy of the made Order, a plan illustrating the proposal, a statement explaining why the Secretary of State proposes to make the Order and a copy of the Order to be revoked may be inspected during office hours at the offices of Sandwell Metropolitan Borough Council, Development House, PO Box 42, Lombard Street, West Bromwich B70 8RU; Sandwell Council House, Freeth Street, Oldbury B60 3DE or obtained by application to the Highways Agency, Traffic Operations Division Orders Team, Broadway, Broad Street, Birmingham B15 1BL. Any person wishing to question the validity of or of any provision contained in the Order, on the ground that it is not within the powers with respect to the Order conferred by the above Act, or on the ground that any requirement of, or of any instrument made under, any provision of that Act has not been complied with in relation to the Order may, within 6 weeks of 12 January 2006, apply to the High Court for the suspension or quashing of the Order or of any provision contained therein.
