DEVELOPMENT OF PROSPECT MILLS, VICTORIA ROAD, MORLEY
NOTICE TO UNKNOWN OWNER/OCCUPIER(S)
1. Notice is hereby given that Bellway Homes Limited (the “Developer”) has secured
reserved matters approval for 27 houses and 30 flats (Ref 23/124/05/RM) on the site
of the former Prospect Mills of Victoria Road, Morley.
2. Part of the access to the development is proposed over the land described in the
Schedule hereto which is unregistered land and of unknown ownership.
3. Leeds City Council (the “Council”), as highway authority, is minded to enter into
an agreement with the Developer pursuant to section 38 of the Highways Act 1980, for
the adoption of the access road once constructed to and maintained at a standard to
their satisfaction.
4. Before doing so, the Council requires that the Developer make reasonable enquiry
as to the owner of the land.
5. A copy of the planning permission, accompanying plans and a plan showing the land
are available for inspection at the offices of Bellway Homes, at 2 Deighton Close,
Wetherby, West Yorkshire LS22 7GZ, and may be seen weekdays at all reasonable hours.
Alternatively, a copy of the plan of the land is available on request from Hammonds
Solicitors at 2 Park Lane, Leeds LS3 1ES (quoting Ref AXB/BEL.119-33).
6. Any person who considers that they have an interest in the land or has knowledge
as to the ownership of the land should contact Hammonds Solicitors at the address
above within 21 days of the date of this notice.
Schedule
The land is situated on the south-east side of Victoria Road and comprises of 36
square metres of overgrown land fenced from the adjoining highway verge and footpath
on Victoria Road by metal railings and located 90 metres south-west of the junction
of Victoria Road and Victoria Avenue and 50 metres north-east of the junction of Victoria
Road and Ingle Avenue.
