HIGHWAYS ACT 1980
THE BIRMINGHAM CITY COUNCIL (SELLY OAK NEW ROAD PHASE 2) (A38 CLASSIFIED ROAD) (SIDE ROADS AND OTHER WORKS) ORDER 2004
The Secretary of State for Transport hereby gives notice that he has confirmed, with modifications, the above Order which was made by Birmingham City Council under sections 14 and 125 of the Highways Act 1980, and which, as confirmed, authorises the Council to: (a) improve lengths of highways; (b) stop up highways; (c) construct new highways; (d) stop up private new means of access; and (e) provide new means of access to premises, all on or in the vicinity of the route of the A38 classified road, being the highway which the Council propose to construct from a point 27 metres west of the centre line of the Birmingham and West Suburban Railway Line to a point 97 metres east of the centre line of the Bristol Road/Arley Road junction. Copies of the above-mentioned Order and of the plans referred to therein have been deposited and may be seen at all reasonable hours, free of charge, at the offices of Birmingham City Council, Transportation Strategy, 1 Lancaster Circus, Queensway, Birmingham B4 7DQ, and at Selly Oak Library, 669 Bristol Road, Selly Oak, Birmingham B29 6AE. Any person aggrieved by the Order and desiring to question the validity thereof, or of any provision contained therein, on the ground that it is not within the powers of the Highways Act 1980 or on the ground that any requirement of that Act or of any regulations made thereunder has not been complied with in relation to the Order, may, within 6 weeks of 25 November 2005, apply to the High Court for the suspension or quashing of the Order or of any provision contained therein.
