PENWITH DISTRICT COUNCIL (OFF-STREET PARKING PLACES) ORDER 2005

Notice is hereby given that the District of Penwith in exercise of its powers under section 35(1) and (3) of the Road Traffic Regulation Act 1984, as amended by the Parking Act 1989 and Part IV of Schedule 9 to the Act and of all other enabling powers with the consent of the County Council of Cornwall in accordance with Part III of Schedule 9 to the Act, made the following Order. The details of the proposal to make the Order were previously published in the Cornishman and The London Gazette on 17 March 2005, and in the St Ives Times and Echo on 18 March 2005. The Order shall come into operation on 1 June 2005, and may be cited as the Penwith District Council (Off-Street Parking Places) Order 2005. The effect of the Order will redefine the policy of residential and business use reserved parking in St Ives, and will amend the categories of parking tickets available for purchase. A copy of the Order may be examined during normal office hours at the Council Offices, St Clare, Penzance. Any person who wishes to question the validity of the Order or any provision contained therein on the grounds that it is not within the powers contained in the Road Traffic Regulation Act 1984, or on the grounds that any requirement of the Act or of any Instrument made under it, has not been complied with in relation to the Order, may, within 6 weeks from 1 June 2005, apply to the High Court for this purpose.
