TRANSFER OF APPOINTMENTS BETWEEN OFFICE HOLDERS

Notice is hereby given that, pursuant to the Order of Mr Justice Lightman sitting as a Judge of the High Court of Justice in the Chancery Division of the Royal Courts of Justice, London, on 30 June 2004:

A. RAYMOND HOCKING (“Mr Hocking”), licensed Insolvency Practitioner and former Partner of BDO Stoy Hayward LLP has been removed from the following offices:

1. As Joint Liquidator of Fosters Trading Company (Holdings) Ltd (in Members’ voluntary liquidation) and those other companies in Members’ voluntary liquidation listed in Schedule B below. Mr Hocking has not been replaced as matters are well advanced and do not require another joint appointee;
2. As Liquidator of Mallard Estates Limited (in Creditors’ voluntary liquidation) and those other companies in Creditors’ voluntary liquidation listed in Schedules C to I below. In respect of those Companies listed in Schedule C below, Malcolm Cohen (“Mr Cohen”), a licensed Insolvency Practitioner and partner in BDO Stoy Hayward LLP, has been appointed Liquidator in place of Mr Hocking. In respect of the Company in Schedule E below, for which Mr Hocking is one of two Joint Liquidators, Mr Cohen has been appointed Liquidator in place of Mr Hocking. In respect of those companies in Schedules D and F to I below, for which Mr Hocking is one of two Joint Liquidators, Mr Hocking has not been replaced as matters are well advanced and do not require another joint appointee;
3. As Joint Liquidator of Baltak Limited (in compulsory liquidation). Mr Hocking has not been replaced as matters are well advanced and do not require another joint appointee;
4. As sole Liquidator of Manlon Trading (in compulsory Liquidation) and those other companies in compulsory liquidation listed in Schedule K below. Mr Cohen has been appointed sole Liquidator in place of Mr Hocking;
5. As Trustee in Bankruptcy of the estate of Roy Bisset and of those other individuals listed in Schedules L to N below. In respect of those estates listed in Schedule L, Mr Cohen has been appointed Trustee in Bankruptcy in place of Mr Hocking. In respect of those estates in Schedules M and N, for which Mr Hocking was one of two joint Trustees in Bankruptcy, Mr Hocking has not been replaced as matters are well advanced and do not require another joint appointee;
6. As Court Appointed Receiver of Mark Goldberg. Mr Hocking has not been replaced as the matter is well advanced and does not require another joint appointee;
7. As Supervisor of the individual voluntary arrangements listed in Schedules P and Q below. In respect of those estates listed in Schedule P, Mr Cohen has been appointed Supervisor in place of Mr Hocking. In respect of the individual voluntary arrangement listed in Schedule Q, for which Mr Hocking was one of two Joint Supervisors, Mr Hocking has not been replaced as the matter is well advanced and does not require another joint appointee;
8. As Supervisor of the Company voluntary arrangement listed in Schedule R below. Mr Hocking has not been replaced as matters are well advanced and do not require another joint appointee;
9. As Joint Administrator of Wimbledon & South West Finance Plc (in administration) and those other companies in administration listed in Schedules T and U below. Mr Hocking has not been replaced as matters are well advanced and do not require another joint appointee;
10. As Joint Sequestrator of the estate of Nicholas van Hoogstraten. Simon James Michaels, a licensed Insolvency Practitioner and partner in BDO Stoy Hawyard LLP, has been appointed in place of Mr Hocking.

B. RAYMOND HOCKING AND GEORGE ALBERT AUGER, former partners of BDO Stoy Hayward LLP have been removed from office as Joint Judicial Trustees of the estate of EJC Williams (deceased) and replaced by Malcolm Cohen, licensed Insolvency Practitioner and partner in the firm of BDO Stoy Hayward LLP.

Please Note
1. Any person affected by the Order is permitted to apply to vary or discharge the Order provided that such application is made within 28 days of this notice and on substantial grounds.
2. Mr Hocking may apply to the Secretary of State for his release from liability in respect of the insolvency appointments listed in Schedules A to N below within 21 days of this notice save in respect of any claims notified by that date.
3. Mr Hocking will be released from liability in respect of his other appointments listed in Schedules O to W with effect from 28 days of this notice save in respect of claims notified by that date.
4. Mr Auger will be released from liability in respect of his appointment as Joint Judicial Trustee of the estate of EJC Williams (deceased) with effect from 28 days of this notice save in respect of claims notified by that date.
5. In the case of the estates in Bankruptcy or in liquidation where there is a Creditors’ Committee, it is open to the Committee to require Mr Hocking to provide an account of his administration for the insolvency, including a summary of receipts and payments, and a statement that he has reconciled his account. Where there is no committee, a similar request may be made by an individual Creditor, but this will only be complied with if the Creditor applies to the Court within 28 days for such an Order and the Court grants it. Unless there are good reasons to the contrary, the costs which Mr Hocking would incur in complying with any such requirement would be paid as part of the expenses of the individual insolvency.
6. Creditors of any estates in liquidation or Bankruptcy affected by the Order are reminded that they may also call for a statement of receipts and payments under regulations 11 and 25 respectively of the Insolvency Regulations 1994.
