ZONE CW EXTENSION

1. Notice is hereby given that the London Borough of Merton, after consulting the Commissioner of Police of the Metropolis, propose to make the above-mentioned Orders under Sections 6, 45, 46, 47 and 124 and Part IV of Schedule 9 of the Road Traffic Regulation Act 1984, as amended by the Local Government Act 1985 and Part II of the Road Traffic Act 1991. The Orders were made on 21 April 2004, and shall become operational on 10 May 2004. 2. The general effect of the Orders are: (a) to introduce waiting restrictions operating at the times indicated in the roads specified in Schedule 1 to this notice; (b) to introduce permit-holder bays in the roads detailed in Schedule 2 to this notice; (c) to introduce shared use bays operating at the times indicated in the roads detailed in Schedule 3 to this notice. 3. Nothing in these Orders will apply to anything done with the permission or at the direction of a police constable in uniform. 4. Exemptions to 2(a) above are provided in the Order to permit vehicles to wait: (a) to enable passengers to board or alight and to load or unload their personal luggage; (b) or up to 20 minutes for the purpose of delivering and collecting goods or loading/unloading the vehicle at premises adjacent to the street; (c) if they are being used to maintain the road or the services therein or by local authorities or the Post Office in pursuance to statutory powers and duties. 5. A copy of the Orders, plans identifying the areas affected by the Orders and the Council’s Statement of Reasons for making the Orders can be inspected during the Council’s normal office hours Mondays to Fridays at Merton, Merton Civic Centre, London Road, Morden, Surrey, and during normal opening hours at the Colliers Wood Library. 6. Any person desiring to question the validity of the Orders or of any provision contained therein on the grounds that they are not within the powers conferred by the Road Traffic Regulation Act 1984, or on the grounds that any requirement of the Act, or of any Instrument made under it has not been complied with in relation to the Orders, may, within 6 weeks from the date which the Orders were made, apply to the High Court for this purpose. Schedule 1 1.  Waiting Restrictions operating at all times Byegrove Road, from a point 9 metres east of the western property wall of No 100 Byegrove Road, eastwards, for a distance of 6 metres. North Gardens, from a point opposite the party wall of Nos 25 and 27 North Gardens to its eastern extremity. South Gardens: North Side: From a point 63 metres east of its junction with Valley Gardens to its eastern extremity. South Side: From a point 2 metres west of the party wall of Nos 23 and 25 South Gardens to its eastern extremity. Wandle Bank: East Side: From a point opposite the party wall of Nos 1 b and 1 c Wandle Bank to its southern extremity. West Side: From a point 2 metres north of the party wall of Nos 1 a and 1 b Wandle Bank to its southern extremity. 2.  Waiting Restrictions operating Monday to Friday between 8.30 am and 6.30 pm Byegrove Road, from its junction with South Road to a point 9 metres east of the western property wall of No 100 Byegrove Road. North Gardens, from its junction with Valley Gardens to a point opposite the party wall of Nos 25 and 27 North Gardens. South Gardens: North Side: From a point 12 metres east of its junction with Valley Gardens, eastwards, for a distance of 63 metres. South Side: From a point 12 metres east of its junction with Valley Gardens to a point 2 metres west of the party wall of Nos 23 and 25 South Gardens. South Road, from a point opposite the party wall of Nos 25 and 27 South Road to its eastern extremity. Valley Gardens: (a) From a point 5 metres south-east of the north-western wall of No 2 Valley Gardens to its junction with South Gardens; (b) From a point 5 metres north-west of the north-western wall of No 2 Valley Gardens, north-westwards, for a distance of 5 metres. Schedule 2 Permit Holder Bays Operating Monday to Friday between 8.30 am and 6.30 pm Byegrove Road, north side, from a point 14 metres west of the south-western property wall of No 100 Byegrove Road, eastwards, for a distance of 23 metres. North Gardens: North Side: From a point 7 metres east of its junction with Valley Gardens, eastwards, for a distance of 56 metres. South Side: From a point 67 metres east of its junction with Valley Gardens, eastwards, for a distance of 5.50 metres. South Gardens: North Side: From a point 12 metres east of its junction with Valley Gardens, eastwards, for a distance of 63 metres. South Side: From a point 24 metres west of the party wall of Nos 13 and 15 South Gardens, eastwards, for a distance of 17 metres. Valley Gardens, west and south-west side, from a point 5 metres south-east of the north-western wall of No 2 Valley Gardens to a point 10 metres north of its junction with South Gardens. Wandle Bank: West Side: From a point opposite the party wall of Nos. 50 and 51 Wandle Bank to a point 3 metres south of the party wall of Nos 34 and 36 Wandle Bank. East Side: (i) From a point 2 metres south of the northern property wall of Nos 37 to 50 Kendall Court, Byegrove Road, southwards, for a distance of 12.50 metres. (ii) From a point 2 metres north of the party wall of Nos 12 and 13 Wandle Bank to a point opposite the party wall of Nos 1 and 2 Wandle Bank. Schedule 3 Shared Use Pay and display Bays, operating Monday to Friday between 8.30am and 6.30pm, maximum stay 10 hours, 50p per hour, free to permit holders at all times.
