THE BRENT (WAITING AND LOADING RESTRICTION) (AMENDMENT NO 162) ORDER 2004
QUEENSBURY STATION PARADE CPZ—(QA ZONE)
1. Notice is hereby given that the Council of the London Borough of Brent on 12 January
2004 made the above-mentioned Orders under sections 6, 45, 46, 49 and 124 of and Part
IV of Schedule 9 to the Road Traffic Regulation Act 1984 as amended by section 8 of
and Part 1 of Schedule 5 to the Local Government Act 1985, the Parking Acts of 1986
and 1989 and the Road Traffic Act 1991.
2. The general effect of the “Parking Places” Order will be to:
(a) designate parking places that will operate between 10.00 am and 3.00 pm on Mondays
to Saturdays inclusive in certain lengths of the streets specified in Schedules 1,
2 and 3 to this notice;
(b) specify that:
(i) each parking place may be used, subject to the provisions of the Order, for the
leaving during the permitted hours of such vehicles as are passenger vehicles, goods
carrying vehicles or invalid carriages displaying a valid parking ticket or permit.
Motor cycles park free;
(ii) the maximum initial period for which a vehicle displaying a valid parking ticket
may be left during the permitted hours in the parking places specified in Schedule
1 to this notice will be 2 hours;
(iii) the charge for short term parking in the parking places specified in Schedule
1 to this notice will be 20 pence for 20 minutes, 40 pence for 40 minutes, 80 pence
for 1 hour and £1.60 for 2 hours, the tickets for which will be issued by pay and
display meters;
(iv) the interval before a vehicle may again be left in a parking place after the
expiration of the period for which the initial charge was incurred will be 2 hours;
(v) any resident whose usual place of abode is in any street specified in Schedule
4 to this notice may apply to the Council for the issue of a residents permit valid
for use in the parking places specified in Schedules 2 and 3 to this notice;
(vi) a maximum of 3 permits per residential postal address will be issued by the
Council or its agents, to persons whose usual place of abode is in any street specified
in Schedule 4 to this notice. The charges will be £50 per annum (£25 if the vehicle
engine size is less than 1100cc) or £31 for 6 months (£15.50 if the vehicle engine
size is less than 1100cc) for the first permit, £75 per annum (£43.50 for 6 months)
for the second permit and £100 per annum (£56 for 6 months) for the third permit.
Unexpired permits that have been paid for and surrendered to the Council will be entitled
to a refund of one twelfth of the charge paid (one sixth for 6 months permits) in
respect of each unexpired month, subject to a maximum refund of 3 months;
(vii) any resident whose usual place of abode is in any street or part of street
specified in Schedule 4 to this notice may apply to the Council for the issue of visitor’s
permits up to a maximum of 150 per annum per residential postal address at a cost
of 50 pence per permit per day of use. Unlimited additional visitors permits issued
to the same residential postal address cost £1 per permit per day of use;
(viii) any resident whose usual place of abode is in any street or part of street
specified in Schedule 4 to this notice may apply to the Council for the issue of a
household visitor permit valid for use in the street for which it is issued at a cost
of £75 per annum;
(ix) any person who occupies premises in any street specified in Schedule 4 to this
notice and who uses such premises for non-residential purposes may apply to the Council
for the issue of a general business permit (maximum 3 permits per individual organisation)
valid for use in the parking places specified in Schedules 2 and 3. The charge for
each general business permit will be £300 per annum (£160 for 6 months, £90 for 3
months);
(x) any person who occupies premises in any street specified in Schedule 4 to this
notice and who uses such premises for non-residential purposes may apply to the Council
for the issue of a liveried vehicle business permit (maximum 3 permits per individual
organisation) for any of its vehicles marked with the Company livery for use in the
parking places specified in Schedules 2 and 3. The charge for each liveried vehicle
business permit will be £180 per annum (£100 for 6 months, £60 for 3 months);
(xi) permits issued by the Council to essential users will be valid for use in all
the parking bays provided for resident and business users in the QA zone. The charge
for each essential user permit will be £75;
(xii) any resident of a “car free” development as defined in a section 106 agreement
made under the Town and Country Planning Act 1990 will not be eligible for a residents
permit in the QA zone.
3. The general effect of the “Waiting and Loading Restrictions” Order will be further
to amend the Brent (Waiting and Loading Restriction) Order 1979, so that:
(a) waiting by vehicles (otherwise than for the purpose of delivering or collecting
goods or loading or unloading a vehicle) will be prohibited at “at any time” (mainly
at junctions) or between 10.00 am and 3.00 pm on Mondays to Saturdays in certain lengths
of the streets specified in Schedule 5 to this notice;
(b) waiting by vehicles for the purpose of delivering or collecting goods or loading
or unloading a vehicle will be prohibited between 8.00 am to 9.30 am and 4.30 pm to
6.30 pm on Mondays to Fridays in certain lengths (mainly at junctions) of the streets
specified in Schedule 6 to this notice;
(c) waiting by vehicles for the purpose of delivering or collecting goods or loading
or unloading a vehicle for a period of more than 20 minutes in the same place will
now be prohibited between 11.00 am and 6.30 pm throughout the week or between 11.00
am and 3.00 pm on Mondays to Saturdays inclusive in certain lengths of the streets
specified in Schedules 5 and 6 to this notice;
(d) the sale or offer for sale of goods from a vehicle will be prohibited unless
there is in force a valid licence issued by the Brent Borough Council or the goods
are immediately taken into or delivered at premises adjacent to the vehicle from which
the sale is affected;
(e) the use of any vehicle or of any animal or the wearing of fancy dress or other
costume, wholly or mainly for the purpose of advertising, will be prohibited;
(f) any existing prohibition on the waiting by vehicles (including for the purpose
of loading or unloading a vehicle), the sale or offer of sale of goods from a vehicle
or the use of any animal or the wearing of fancy dress or other costume wholly or
mainly for the purpose of advertising, in the lengths of streets specified in Schedule
5 will be revoked.
4. The prohibitions referred to in paragraph 3(a), 3(b) and 3(c) above will not apply
in respect of anything done with the permission or at the direction of a police constable
in uniform or in certain circumstances, e.g., the picking up or setting down of passengers;
the carrying out of statutory powers or duties; the taking in of petrol, etc., from
roadside petrol stations; to licensed street traders, etc. The usual exemption relating
to vehicles displaying a disabled person’s “Blue/Orange Badge” will apply.
7. A copy of each of the Orders, which will come into operation on 26 January 2004,
of a map of the relevant area, of the above-mentioned Order of 1979 (and of the Orders
which have amended that Order) can be inspected during normal office hours on Mondays
to Fridays inclusive until the end of 6 weeks from the date on which the Orders were
made at:
(a) The One Stop Shop, Brent Town Hall, Forty Lane, Wembley, Middlesex HA9 9HX; and
(b) The One Stop Shop, Brent House, 349-357 High Road, Wembley, Middlesex HA9 6BZ.
8. Copies of the Orders may be purchased from the address mentioned in paragraph
7(b) above.
9. Any person desiring to question the validity of either of the Orders or of any
provision contained therein on the grounds that it is not within the relevant powers
of the Road Traffic Regulation Act 1984, or that any of the relevant requirements
thereof or of any relevant regulations made thereunder has not been complied with
in relation to either of the Orders may, within 6 weeks of the date on which the Orders
were made, make application for the purpose to the High Court.
