The Secretary of State hereby gives notice that he has made an Order under section 247 of the above Act, which will authorise the stopping-up of lengths of highway at Chamberlain Close, Clifton, Nottingham, measuring a length of 36 metres. The stopping-up will be authorised only in order to enable the development described in the Schedule to this notice to be carried out in accordance with the planning permission granted to Nottingham City Council, Housing Department, by the Nottingham City Council on 26 February 2002, under Ref 01/02470/NFUL3. The Order will require the provision of a new highway and the improvement of existing highway by Nottingham City Council, Housing Department, maintainable at public expense, and for which the highway authority is to be the Nottingham City Council. Copies of the Order and relevant plan may be inspected at all reasonable hours during the 6 weeks challenge period commencing on 3 November 2003 at the Nottingham City Council, The Guildhall, Burton Street, Nottingham NG1 4BT, and may be obtained, free of charge, from the Government Office for the East Midlands (quoting Ref EMCM 507035/1/197) at the address below. Any person aggrieved by the Order and desiring to question the validity thereof, or of any provision contained therein, on the ground that it is not within the powers of the above Act or that any requirement of that Act or of any regulation made thereunder has not been complied with in relation to the Order may, within 6 weeks of 3 November 2003, apply to the High Court for the suspension or quashing of the Order or of any provision contained therein.
