THE A1 TRUNK ROAD (FOSTON TO LONG BENNINGTON LINK ROAD) COMPULSORY PURCHASE ORDER (OD NO 61) 2003

1. Notice is hereby given that the Secretary of State for Transport in exercise of his powers conferred on him by the above-mentioned Acts, on 12 September 2003 made a Compulsory Purchase Order, entitled as above.
2. The Order as made provides for the purchase of the land described in the Schedule hereto for the purpose of:

(a) the construction and improvement of highways and the provision of new means of access at Foston and Long Bennington in the District of South Kesteven in the County of Lincolnshire in pursuance of the A1 trunk road (Foston to Long Bennington Link Road, Side Roads) (No 2) Order 2003;
(b) the improvement of the A1 trunk road between Foston and Long Bennington in the said District; and
(c) use by the Secretary of State in connection with such construction and improvement of the highways.

3. Copies of the Order as made by the Secretary of State, together with copies of the published made Order mentioned at (a) above each with its accompanying plan have been deposited and may be seen during normal office hours, free of charge, from 12 September 2003 to 23 October 2003 at the Highways Agency, Traffic Operations Directorate, Room C3, Broadway, Broad Street, Birmingham B15 1BL; Lincolnshire County Council, County Offices, Newland, Lincoln LN1 1YQ; South Kesteven District Council, Council Offices, St Peter’s Hill, Grantham NG31 6PZ, and Sub Post Office, Potts Store, 46 Main Road, Long Bennington, Newark, Nottinghamshire NG23 5DJ.
4. The Order as made becomes operative on the date on which this notice is first published: but a person aggrieved by the Order may, by application to the High Court within six weeks from the operative date, question its validity on the grounds:

(a) that the authorisation granted by the Order is not empowered to be granted or
(b) that their interests have been substantially prejudiced by failure to comply with any statutory requirement relating to the Order.
