THE LONDON BOROUGH OF MERTON (FREE PARKING PLACES) (DISABLED PERSONS) (REVOCATION) (NO 15) TRAFFIC ORDER 2003

1. Notice is hereby given that the London Borough of Merton, after consulting the Commissioner of Police of the Metropolis, have made the above-mentioned Orders under sections 6 and 124 and Part IV of Schedule 9 of the Road Traffic Regulation Act 1984, as amended by the Local Government Act 1985 and the Road Traffic Act 1991. The Orders were made on 30 July 2003, and shall become operational on 4 August 2003. 2. The general effect of the Orders will be to: (a) designate parking places in the roads listed on the Schedule 1 to this notice in which vehicles authorised by the Order may be left for any period during the permitted hours without charge; (b) provide that the parking place will operate at all times; (c) specify, in respect of the parking place, that disabled persons’ vehicles displaying, in the relevant position, a disabled persons badge (commonly referred to as “the Orange or Blue Badge”) issued by any local authority under the provisions of the Disabled Persons (Badges for Motor Vehicles) Regulations 1975, 1982 or 2000 (as amended) may be left therein; and (d) provide that certain vehicles may wait in the parking places in certain circumstances, eg to allow persons to board or alight (maximum 2 minutes), etc. (e) to revoke the disabled persons parking places in the locations detailed in Schedule 2 to this notice. 3. Nothing in the Orders shall apply to anything done with the permission or at the direction of a police constable in uniform. 4. A copy of the proposed Orders, and of the Council’s statement of reasons for making the Orders and plans which indicates each length of road to which the Orders relate can be inspected at Merton Link, Merton Civic Centre, London Road, Morden, Surrey. 5. Any person desiring to question the validity of these Orders or of any provision contained in them on the grounds that it is not within the powers conferred by the Road Traffic Regulation Act 1984, or on the grounds that any requirement of the Act, or of any Instrument made under it has not been complied with in relation to the Orders, may, within 6 weeks from the date which the Orders were made, apply to the High Court for this purpose.
